Chief Prosecutor Olsian Çela , during his report to the Laws Committee, expressed criticism of the First Instance prosecutors, stating that they complain to embassies about the actions of the Appeals Court.
"We have reached a day where prosecutors are putting into question what the Appeals Court decides," said Chief Prosecutor Çela.
He added that, especially young prosecutors, " do not understand their place and position ."
Olsian Çela : We have cases where first instance prosecutors complain about Appeals decisions, we have reached a day where prosecutors put into question what the Appeals Court decides.
They write letters, they address institutions and embassies where they raise issues related to the legality of the courts of appeal. It is unacceptable and inconceivable.
This is because a system has been set up where prosecutors, especially young ones, do not understand the place and position of the prosecutor. To add fuel to the fire, we have the case law and the decision of the Supreme Court.
The Supreme Court says that the first instance prosecutor can exercise recourse in the High Court, at a time when the Appeals Prosecutor has given up on the Appeal. Tell me how many cases you have represented in the High Court, there are 38 cases.
