He has been employed in the local administration since 2011, but the SPAK file for abuse of office cost the Albanian with the initials SH.B peace of mind at work even after the investigation was completed.
The decision of the special court of first instance for corruption and organized crime ordered his suspension from duty in March, and about 7 months later decided to end the security measure, returning him to work in September.
But the reinstatement of the position confronted the journalist, according to the denunciation document provided by Top Channel, with a discriminatory environment every day.
An employee of the Patos municipality, in the position of general secretary, has complained to the Commissioner against Discrimination, alleging that he was treated differently and unequally at work by the Mayor of the Municipality, Fation Duro, because he was a defendant in the SPAK.
"The Mayor of Patos has avoided all the functions that I should have exercised as Secretary General and so far the duties carried out by me in my capacity as secretary are zero, as I was deliberately not assigned any duties.
"All the employees of the Municipality avoid me and do not report to me according to the law. Since September 26, in the meetings that the Mayor has periodically organized in the meeting room with the heads of the Municipality administration, I have not been notified and have not participated in any of them."
He lists a series of problems since the moment he resumed work, such as changing his office, approving a lower salary compared to his subordinates, not being included in work WhatsApp groups or in the recruitment and restructuring committees of the municipality's structure, making him feel isolated, singled out, and even overlooked for the effective exercise of his functions as secretary general, with the justification that the discrimination against him came from his social status.
"The office where I exercised my functions before the suspension is on the second floor of the building, the floor where the offices of the Municipality's leaders are located. Currently, the office where I am located is on the third floor, while the office where I was before still has the name 'General Secretary', even though I am no longer in that office. The new salaries proposed by the Municipality's executive have been approved with an increase for all civil servants.
It is clear that in determining my salary there is a pronounced discrimination, as there is a treatment at least 25% to 29% lower. What is striking is that I, as the highest management official, have a lower salary than my subordinates, who are the directors of the directorates, who are the middle management level. My salary is very close to the salary of the sector manager, who is the low management level.
The Commissioner, in a decision of 2025, assessed that the Patos Municipality had prejudiced the complainant's judicial status, violating the constitutional principle of the presumption of innocence.
During the review of the complaint through written exchange, but also during a hearing where the parties faced each other, the commissioner formed the conviction that the Municipality has not implemented the same trend in salary increases, has not respected the hierarchy of functions and has violated the dignity of the complainant.
While regarding the complaint of obstruction of duty, the municipality's argument that not exercising responsibilities was his choice, the anti-discrimination commissioner explains that the non-engagement, exclusion, and non-involvement of the complainant in exercising his function as secretary general is an action that violates the law.
The employer's actions, he further assessed, have violated not only the individual right to work, but also the public interest, since the complainant is paid by Albanian taxpayers. For these reasons, the commissioner decided to establish discrimination in the form of harassment, due to the judicial status of the secretary of the Patos Municipality./ TCH
