The criminal case against Dritan Zaganin, former head of the Narcotics Section of the Fier Police, must be retried from the beginning. This is what the Constitutional Court has decided, which on July 21, 2026, decided to overturn the decision of the High Court.
Zagan's lawyer, Dorian Matlija, was only sent the decision today and he says that justice has already taken an important turn, which will shed light on how the former Anti-Drugs chief was sentenced to 4 years and 6 months.
He was found guilty of the criminal offenses of "abuse of office" and "failure to report a crime", but according to the lawyer, the Albanian justice system found no evidence to show that Dritan Zagani had benefited from his position or that he had favored traffickers.
"On the contrary, the episodes used against him are related to successful operations that led to the seizure of 109 kilograms of cannabis in Albania and the arrest in Italy of a person with 6 kilograms of cocaine. However, the courts convicted him without identifying any specific law violated, any damage caused, or any criminal intent by Zagan," the lawyer writes.
Legal defender Dorian Matlija says that the case cannot be separated from the political context because Dritan Zagani had denounced former minister Saimir Tahiri's connections with the Habilaj group, drug trafficking and the disclosure of police operations.
"Time showed that Zagan's denunciations were not a fantasy. The Habilaj Group became the subject of criminal proceedings and former Minister Tahiri was criminally convicted. Meanwhile, Zagan, publicly declared guilty by the Prime Minister before the court's decision, was forced to leave the country and today lives under the protection of political asylum," says the lawyer.
