The Union of Albanian Journalists has spoken out against the decision of the Prosecutor's Office to ban the publication of any data published by the authors of the cyber attack, which has affected the data in the Albanian state system.
Through a statement, he said that such a decision neither protects nor prevents the publication of personal data, but above all violates constitutional freedom.
" This prosecutor's decision is not related to a case or a specific aspect of security, but tends to hold accountable those journalists and media that use the information "poured out publicly from the "faucet" or computers" sabotaged by the state. This measure does not prevent nor does it protect. This decision only punishes something else, the professional right that is related to basic freedom in our society ," the statement says.
Full statement
The Union of Albanian Journalists is aware of the decision of the prosecutor of the Prosecutor's Office of the Judicial District of Tirana dated 19.09.2022, for the sequestration of data, within the framework of criminal proceedings No. 5430 of 2022, for the criminal offenses "Interference with computer data" , "Interference in computer systems", and "Misuse of equipment". According to this decision, the Prosecutor's Office prohibits the publication of any data published by the authors of the cyber attack, which has affected the data in the Albanian state system.
The decision of the prosecutor and the forwarding of the official notification by the State Police also creates a new moment between the right and freedom of publication and information as well as the obligation to respect a decision of the prosecution body.
This decision creates a situation that puts the Albanian editor of the entire multimedia spectrum in a difficult position.
This decision and the threatening warning for non-publication of any data published by the authors of the cyber attack in the audiovisual media, written, online, social networks or in the form of publication or data transfer, leaves room for discussion and creates space for censorious influence on media and journalists.
The decision of the Prosecutor's Office is not exhaustive for the prevention or protection claimed, if we take into consideration the fact that currently in the international media and online networks in the region, these data are being circulated and published regardless of the prosecutor's decision and the order of Unit C to Cybercrime investigation in the State Police, including the AMA and the Electronic and Postal Communications Authority AKEP.
UGSH supports the law-enforcement institutions in the country and asks them that in the conditions of such an alarming situation, which was not possible before, they search and hold accountable those institutions and those individuals who have the obligation to preserve and protect documentation or official information in the country .
