Ministry of Defense: The truth about the purchase of three firefighting aircraft

The Ministry of Defense has reacted after several articles and accusations from the Democratic Party, regarding the tender for the purchase of three firefighting aircraft.

According to the Ministry, the tender was conducted in full compliance with Albanian legislation in force and that there is no truth that the winning company is under a ban from contracting with public administrations.

In relation to the recent statement made by the Democratic Party and the circulation on several portals on the procurement procedure for the purchase of three firefighting aircraft, the Ministry of Defense clarifies the public opinion that every procurement procedure in the field of defense and security is carried out in full compliance with the Albanian legislation in force, based on the principles of legality, transparency, competition and equal treatment of economic operators.

The Ministry of Defense rejects claims that this is a "closed tender" or a procedure conducted in violation of the law.

The procedure was developed as a competitive procedure for military purposes, in accordance with Albanian legislation on procurement in the field of defense and security.

Two economic operators participated in the competition. The winning operator submitted the lowest price bid, while the other operator was disqualified for not meeting the legal criteria of qualification, economic and technical capacity.

Equally untrue is the claim that the winning company is prohibited from contracting with public administrations.

AVIATION TRADE EUROPE, SL has submitted a criminal record certificate certifying the absence of any criminal record and retains the full right to participate in public procurement procedures.

The allegations referred to in the media are related to another court case in Spain, where the decision has not yet become final and is under review by the Supreme Court. Consequently, it does not produce legal effects and does not constitute a legal basis for the exclusion of any economic operator from procurement procedures.

The company has continued to contract normally with public administrations of NATO member countries and other international partners, including in recent years the Ministry of Defense of Cyprus and the Ministry of Interior of Montenegro.

The investment in providing aerial firefighting capacities is a project of strategic importance for increasing civil security, protecting the lives of citizens, property and the environment. For this reason, the Ministry of Defense remains committed to ensuring that every procedure is carried out with full responsibility, in respect of the law and the public interest.
