The new criminal code brings an increase in criminal offenses related to food safety, specifically the production of food hazardous to health, the provision of unsafe food, fraud with food products, and the false representation of food products.

Referring to Article 458 of the draft law, "The production, processing, storage, trade, import, export of food, beverages and other foodstuffs, the use of chemicals, materials and additives in the production and processing of foodstuffs in violation of permitted legal standards, or their use in animals and plants used as food, in violation of legal requirements, making foods unsafe for consumption, is punishable by imprisonment from six months to 4 years.

The criminal offense of Providing Unsafe Food criminalizes the slaughter of animals for sale or the use of animal products for human consumption, knowing that they have been treated with therapeutic treatments containing harmful substances. The penalty in this case is up to 4 years in prison. It is also criminalized to dispose of meat or animal products intended for food for public consumption, without respecting the withdrawal periods provided for by law.

According to Article 460 on food fraud, "Importing, producing, storing, falsifying, advertising, trading or placing on the market in any other way of foods, materials or additives in the production and processing of food items, on which data is marked that does not correspond to the content, type, categorization, origin, quantity or quality of the product or products without the above data, as provided for in the legislation in force, is punishable by imprisonment for up to three years."

The criminal offense of false representation of a food product makes it criminally punishable by imprisonment for up to 6 months to offer food products on the market by not meeting or changing the requirements set out in the law for expiration or composition, concealing or receiving food products that are intended to be rendered unusable or disinfected, with the aim of trading them.

Also, the criminal offense of Defacing signs of state bodies in the field of food safety punishes the removal or alteration of blocking signs or the exercise of activity after blocking in violation of temporary or final measures, imposed by the inspection bodies of the national food authority, with the aim of producing or trading unsafe food.
