Holta Zaçaj: Constitutional Court decisions must be implemented,
Holta Zacaj

The President of the Constitutional Court, Holta Zaçaj, has stated that the decisions of the institution she heads are neither advisory nor optional, but mandatory to be implemented.

During her speech at the event "Constitutional Jurisprudence", Zaçaj emphasized that the decisions of the Constitutional Court are mandatory for implementation by all branches of government.

According to her, the failure to implement these decisions violates the integrity of the law, calls the Constitution into question, and undermines public trust.

" The authority of these decisions is not theoretical. Attempts to oppose or question the execution of the decisions of the Constitutional Court not only undermine public confidence in the justice system, but also destabilize democratic governance. Let us not forget, the decisions of the Constitutional Court are neither advisory nor optional to implement. They are mandatory and their execution constitutes a constitutional obligation for all powers," said Zaçaj.

The Head of the Constitutional Court added that "the failure to execute these decisions calls into question only the Constitution and threatens the integrity of the rule of law, which requires all state institutions not only to respect the court's decisions, but also to act within constitutional limits. This is worth keeping in mind that when institutions, including judicial ones, create constitutional conflicts or act outside the constitutional framework, this undermines the legitimacy of the legal system itself and erodes public trust ," said Zaçaj.

Zaçaj reminded those present that it is important for democracy to be constitutional and with limits on power.

"Constitutionality as a way of being is our only passport on the path of integration towards a united Europe. We live in a historic moment not only in Albania but also in the world and we must remember that democracy alone is not enough. Majority rule, even when legal, can lead to laws that limit or violate fundamental rights. Therefore, it is necessary for democracy to be constitutional, with limits to power, respect for the rule of law and an independent judiciary. Only in this way is democracy not simply and only a governing mechanism, but a culture of freedom, responsibility and accountability", - declared Holta Zaçaj.
