Eugen Beci on Zvërnec: With SPAK's investigation, permission can no longer be granted

Former Serious Crimes Prosecutor Eugen Beci explains in the show "Opinion" that SPAK is treating the land issue in Zvërnec not directly as forgery, but in the context of cleaning up the proceeds of crime, with suspicions of forged documents. According to him, this has also led to partial seizures, which have been removed from the companies and are left only in relation to payments that would go through the notary to the land owners.

Beci emphasizes that in this case there is a legal problem, as there are final court decisions on appeal, while the Special Prosecution Office is raising suspicions of forgery, which leads the case to a mix of criminal and civil procedures.

"The SPAK claim is based on suspicion of forgery, but it is investigating the laundering of the proceeds of crime. That is, it has also intervened with the seizure that it removed from the company and left only the money that the notary would transfer to the owners of the land who also made the contract. Here we will stop at a legal concept. We have several legal decisions that have taken final form on appeal and now the Special Prosecution thinks and suspects that we are dealing with forgery. There is a major legal problem, that we enter civil files.

We have a document from 1930 for 230 hectares of land that the Shehu family claims due to the ownership of his grandfather. We have many other elements, but this is not taken separately, it is taken as a whole. The Vlora Prosecutor's Office and the Serious Crimes Prosecutor's Office began an extensive investigation into Palasa, Zvërnec in 2012-2013... and that's where all these problems came up and about the character of the family lawyer that Mrs. Lala mentioned, who was problematic. Here we are now facing a legal concept. We have several final court decisions. From what I read, the claim was made in judicial distortion, but we have a big problem. Forgery, therefore SPAK is not directly intervening in the forgery of documents, it is intervening in the cleaning of the proceeds of the criminal offense with the suspicion of forgery. Because forgery is a matter of fact, either the 1930 land title deed is forged, or it is not. "You can't say we suspect or we don't suspect. That's the fundamental problem ," he said.

According to Beci, the essence of the issue is that forgery is a fact that either exists or does not, and cannot remain at the level of suspicion, while SPAK, according to him, is not directly intervening in the forgery of documents, but in its financial and legal consequences.

The former prosecutor adds that the case is currently facing a situation where previous court decisions are final, but doubts are being raised about them due to allegations of forged documents.

He explains that the state cannot remain outside these processes, since the Property Treatment Agency (ATP) has been a party to the trials. According to him, in these cases two legal paths can be followed: reinstatement or review of the decision, where the latter can only be requested by the parties to the process, if new important evidence is presented, such as a document suspected of being forged.

He concludes that interference through criminal investigation further complicates the permitting process.

"Where are we now? Doubts about the court decisions due to the forgery of papers. We have two elements that we need to take into consideration."

First, the state cannot be left out, as the Prime Minister of the Republic of Albania has said so far, because the Property Treatment Agency has been a party to these processes all along. Since the ATP has been a party, we have two institutions that must intervene: either reinstatement or review. Reinstatement is difficult because the parties have received regular notices. Review is done when important evidence comes that may be falsified.

One of the parties, either the Shehu family or the ATP, when this falsified evidence that SPAK may produce tomorrow, which is so far questionable, comes out, can review a decision, but one of the parties, a third party cannot. The ATP is a state party in this matter.

"By interfering with the investigation, permission is no longer granted there ," he said.
