Amnesty 2026 is stuck in the courts, decisions are delayed and thousands of files await closure

Once again, the judiciary is issuing decisions late. This complaint comes from convicts, who, informing the Ombudsman, explain that they are dragging their feet despite the fact that the 2026 amnesty law, to avoid such a stalemate, also includes cases where decisions are not justified.

This category includes citizens who were under trial and whose verdict was announced by May 31, with the consideration that the citizen has the right to waive the appeal when the crime they committed is among the amnestied offenses.

Meanwhile, as Top Channel journalist Anila Hoxha reports, the prosecution offices, which are prosecuting crimes that are amnestied or that represent the state's accusation in court, have not yet reported to the General Prosecutor's Office on the volume of files that are finally closed.

In total, before the law came into force, it was expected that nearly 10,000 investigations would be closed with pardons, mainly accidents without consequences, drunk driving, unauthorized construction, and misdemeanors.

In the instruction signed by the Prosecutor General, prosecutors are required to decide or dismiss criminal charges, or not to initiate proceedings on reports for crimes that occurred until May 31 and are included in the amnesty. These are crimes that provide for a sentence of up to three years in prison, with the exception of subjects who do not benefit.

The Prosecutor General's instructions tell prosecutors what steps they should follow. To resolve them in this way, prosecutors are also required to close cases that are included in the amnesty, but that were previously suspended due to the failure to find the perpetrators.

There is no number on the number of cases that are amnestied in this way, but they will affect the backlog that has also affected the indictment.

It is expected that in September, according to this instruction, the heads of all prosecution offices will inform the Prosecutor General about the number of beneficiary citizens, cases not initiated, cases dismissed during the investigation and during the trial.
