Another comparison between the absurd decisions of the Special Court highlights differences that raise strong questions about proportionality.

Pëllumb Gjoka, one of the main names in the “Metamorphosis” case, has been finally sentenced in the First Instance to 6 years in prison for providing the conditions and material means to commit murders, participation in a structured criminal group and active corruption of justice officials. His 9-year sentence was reduced by a third due to the summary trial.

At the same time, Greta Gjoci (Pepa) and Antoneta Malo (Pepkolaj), convicted in the Bruno Çobos call center case, have each received 6 years and 8 months in prison for computer fraud and participation in a structured criminal group. The summary trial was also applied in this case.

So, the two women in the call center case each received 8 months more in prison than Pëllumb Gjoka, a dangerous exponent of the criminal world.

The GJKKO found Gjoka guilty of "providing the conditions and material means to commit murder" against Kleanthi Musabelli, Dorjan Duli and Ibrahim Lici, as well as of "structured criminal group" and "active corruption of justice system officials".

He is facing a separate trial in which he is accused of the murder of Gjin Ndoji.

Meanwhile, Greta Gjoci and Antoneta Malo were sentenced to 6 years and 8 months in the call center fraud case. The Special Appeal upheld the sentences on October 5.

Greta is the mother of a 4-month-old baby. After being sent to Pojska prison, the GJKKO decided on October 8 to postpone the execution of her sentence for one year. She has about 3 years and 5 months left to serve in prison.

Antoneta Malo, mother of two minor children, also received a six-month suspension of the execution of her sentence. This decision does not change her sentence of 6 years and 8 months; it only postpones its execution.

Of course, files cannot be compared just by comparing the names of the criminal offenses. Codes provide for different ranges of punishment, the court combines sentences according to specific rules, and responsibility must be individualized for each defendant.

But the citizen also sees the result of the "new justice." A person found guilty of providing the conditions for the commission of several murders, a structured criminal group, and corruption of justice officials ends up with 6 years in prison.

Two women in the call center fraud case end up with 6 years and 8 months each.

This is exactly the type of comparison that the GJKKO needs to provide an answer to the public about what standard it sentences people by.

Many may say that the problem starts with SPAK when the prosecutor formulates the charges, but despite this, the judge remains the one who makes the decision, uninfluenced by the prosecutor.
