The two draft laws submitted to the Assembly by the Socialist Party for the amendment of the Electoral Code regarding the verification of candidates for deputies and mayors for the past during the communist era have been revealed.

According to the initiatives, candidates for deputies, mayors or local councils must submit the application form to the file authority 70 days before the elections. The Dossier Authority will carry out the verification in any case after receiving the notification from the CEC.

The initiatives come a few hours after the Democratic Party filed in the Assembly a draft law for the declassification of all the files of the former Insurance in the period 1944-1991.

SP proposals:

In the law no. 10019, dated 29.12.2008, "Electoral Code of the Republic of Albania", amended, the following changes and additions are made:

Article 1

In Article 63, point 3, it is amended as follows:

"A candidate is a citizen who meets the conditions provided for in articles 45 and 69

of the Constitution, for which the process of verifying the purity of the image is successfully completed, and who is registered as a candidate for deputy, as a candidate for mayor or for local councils in the bodies responsible for the administration of elections".

Article 2

After Article 63, Article 63/1 is added with the following content:

Subjekti zgjedhor, 70 ditë para datës së zgjedhjeve, për listën e kandidatëve, për deputet, për kryetar bashkie dhe për këshillat vendorë, paraqet kërkesën dhe formularin e plotësuar të aplikimit pranë Autoritetit për Informimin mbi Dokumentet e ish-Sigurimit të Shtetit në lidhje me ekzistencën për ta, të informacioneve në dokumente të ish-sigurimit të shtetit, për qëllime të transparencës së pastërtisë së figurës.

Kandidati i pavarur për deputet, për kryetar bashkie dhe për këshillat vendor, 70 ditë para datës së zgjedhjeve paraqet kërkesë dhe formularin e plotësuar të aplikimit pranë Autoritetit për Informimin mbi Dokumentet e ish-Sigurimit të Shtetit në lidhje me ekzistencën për të, të informacioneve në dokumente të ish-sigurimit të shtetit, për qëllime të transparencës së pastërtisë së figurës.

Në çdo rast Autoriteti me marrjen njoftim nga Komisioni Qendror i Zgjedhjeve, lidhur me regjistrimin e listës së kandidatëve 50 ditë përpara ditës së zgjedhjeve që konkurojnë për zgjedhjet e radhës, kryen procesin e verifikimit dhe përgjigjet në përputhje me përcaktimet e nenit 26 dhe 30, të ligjit nr. 44/2015, “Për të drejtën e informimit për dokumentet e ish-sigurimit të Shtetit të Republikës Popullore Socialiste të Shqiqërisë”, të ndryshuar, duke informuar subjektin që ka bërë kërkesën dhe Komisionin Qendror të Zgjedhjeve.Nëse vetëdeklarimi është i rremë në raport me rezultatin e verifikimit, bazuar në parashikimet e nenit 30 të ligjit 45/2015, çështja dërgohet pranë Komisionit Qendror të Zgjedhjeve, i cili e përcjell më tej në organet përgjegjëse të hetimit për kryerjen e veprimeve përkatëse sipas legjislacionit në fuqi.

FOR A CHANGE IN THE LAW NO. 45/2015 "ON THE RIGHT TO INFORMATION ON FORMER STATE INSURANCE DOCUMENTS OF THE SOCIALIST PEOPLE'S REPUBLIC OF ALBANIA", AMENDED

In support of Article 78, Article 81, point 1, and Article 83, point 1 of the Constitution, at the initiative of deputies,

  ASSEMBLY OF THE REPUBLIC OF ALBANIA

DECIDE:

In the law no. 45/2015 "On the right to information about the former insurance documents of the State of the Socialist People's Republic of Albania", amended, the change is made as follows:

Article 1

Item 4, of Article 29, is repealed.

Article 2

Entry into force

This law enters into force 15 days after its publication in the Official Gazette.
