The chairman of the SP Parliamentary Group , Bledi Çuçi, explained why the majority is not taking the mandate of Olta Xhaçka to the Constitutional Court.
In a conference with journalists, Çuçi clarified, according to him, an ambiguity that the SP group proposes to be resolved by receiving an opinion from the Venice Commission.
According to him, the constitution clearly states that the will of the deputy to vote cannot be imposed, and even emphasizes that he is not even responsible for voting.
The majority, said Çuçi, considers that the Constitutional Court has tried to create a new constitutional norm, which is not allowed. He emphasizes that the two decisions that were annulled by the Constitutional Court have also been implemented by the Assembly.
" I think the issue of the report of the Parliament with the CJK is a report that is clearly defined by the Constitution. The GJK has the constitutional authority to repeal any law, decision or act taken by the Assembly if it deems it to be in conflict with the Constitution.
There was a decision of the CJK that annulled two decisions taken by the Assembly. The Assembly of Albania annulled both decisions
In this particular case, there is an unease about the fact that a member of parliament or all members of parliament must veto in a certain way, forced or not. This is a debate that has not received and has not been treated even by the decision of the CJK. On the contrary, the CJK in our judgment has tried to create a new constitutional norm that the constitution itself does not allow.
A decision that comes to the parliament to be voted on, the will of the deputy is independent, even the Constitution says that the deputy is not responsible for the vote given by him.
The only moment when the constitution forces the parliament to vote in a certain way is when the right is given to the opposition to set up investigative commissions. There is another moment when, after several meetings about the lots, the deputy is forced to vote. These are the two moments.
Let's come to GJK. We have decided to solve this impasse with the CJK by asking for an opinion in the Venice Commission ", said Çuçi.
