The Complaints and Sanctions Commission decided this Wednesday to uphold the decision of the State Election Commissioner, Ilirjan Celibashi, to declare the winning candidates in the Durrës district, rejecting the complaint of the Democratic Party candidate, Andia Ulliri.
Ulliri claimed that the mandate should have been given to her, based on the legal quota for gender representation, arguing that, according to the rule that guarantees the inclusion of the less represented gender, it was up to her to replace the declared winning candidate, Arjan Ndoja.
The KAS decision enters into force immediately, but it can be appealed to the Electoral College, at the Administrative Court of Appeal, within five days of its announcement.
The final arguments of the decision will be submitted to the parties the following day.
Ullir's legal representative, Indrit Sefa, stated that Commissioner Celibashi has misinterpreted the provisions of the Electoral Code, bringing to attention Article 64 of the Constitution, which requires that one in three deputies be from the less represented gender.
According to Sefa, the list of candidates is unique and consists of two categories: those with a fixed ranking and those subject to preferential voting, so gender representation must be taken into account in the final distribution of mandates.
