An elderly couple from Germany, Friedrich-Wilhelm, 76, and his wife Juta, 77, sued their neighbors over a very active rooster that crows about 200 times a day, making it impossible for them to rest.
This couple from Bad Salkuflen, in western Germany, claim that they haven't had a quiet day at home in a while, all because of Magda, their neighbour's rooster.
It is said that the rooster starts crowing every day around 8 am and doesn't stop until sunset, or about 200 times a day when the owners lock it up with another chicken.
After years of trying to reason with their neighbors about the energetic popcorn, Friedrich and Juta took them to court to settle the matter.
"The neighbor won't give up his rooster and we have to settle the case in court, as we can't live with him," Friedrich-Wilhelm told reporters.
"We can't use the garden and we can't open any windows. It's unbearable."
"It's hard to talk about our torture, but that's how it is," added his wife, Juta.
The couple's lawyer, Torsten Gieseke, argued that a hyperactive rooster like Magda does not belong in a quiet residential area, adding that another neighbor was forced to leave two years ago because of the incessant crowing, reports Bild.
Magda's singing was said to be around 80 decibels, which is comparable to a busy restaurant or a road with heavy traffic.
Friedrich and Juta began recording Magda's daily crowing as evidence in court and claim that their legal action was the only option available to them after failing to convince the rooster's owner.
Michael D., who owns Magda, told reporters that the rooster plays an important role among his flock of chickens, keeping order among the other birds.
"Chickens need a rooster, otherwise they would peck each other," he told the media.
The judge of the District Court in Lemgo will soon hear the case of Friedrich and Juta and make a decision on Magda's fate.
Interestingly, this is not the first time in the world that rooster crowing ends up in court, writes Bild.
