Law that banned German men from leaving the country without permission from the army is suspended

German Defense Minister Boris Pistorius says men of military age in Germany do not need to report long stays abroad. His statement comes after a controversy over the potential consequences of a new law that reinstated military service in Germany.

The Law on Modernization of Military Service, which came into force on January 1, aims to strengthen defense in the face of threats from Russia following its full-scale invasion of Ukraine.

In a statement sent to the BBC earlier in April, a Ministry of Defence spokesperson confirmed that males over the age of 17 are required to obtain prior approval for stays abroad lasting more than three months.

The request for permission had gone largely unnoticed until it was reported by a German newspaper last week. It is not believed that the request was implemented.

Now, Boris Pistorius of the Social Democratic Party has told the German News Agency (DPA) that he is making an exception.

"Whether they are 17 or 45, or anywhere in between, everyone is, of course, free to travel and currently does not need permission to do so," he said. Long stays abroad will also not need to be reported.

"During this peacetime period, there will be no procedures for obtaining a permit. We are suspending the application for a permit as long as military service is voluntary," Pistorius said.

At the same time, he announced that appropriate procedures would be put in place in the event of a crisis. He defended the regulation “as a precautionary measure.”

The law that came into effect in January restores military service in principle, although it will only be implemented if not enough people voluntarily sign up for the army.

German Chancellor Friedrich Merz has said he wants to create the strongest conventional army in Europe. Since January this year, all 18-year-olds in Germany have been taking a questionnaire asking whether they are interested and willing to join the armed forces.

The questionnaire is mandatory for men and voluntary for women. From July 2027, all 18-year-old men will have to undergo a medical examination to assess their physical fitness for possible military service.
