A New York court has dismissed a lawsuit by a corrupt politician from Liberia, Africa, to have his "non-wife" removed.

Margibi J. Emmanuel Nuquay's request to temporarily lift the travel ban imposed on him by the United States government has been denied by the Southern District Court in New York.

Judge Andrew L. Carter, who issued the ruling, based it on the U.S. State Department’s decision on December 12, 2023, publicly designating Nuquay and other Liberian officials ineligible to enter the United States due to corruption charges. Furthermore, Carter dismissed Senator Nuquay’s case without prejudice, emphasizing the limitations imposed by immigration law and the authority of the Executive Branch in such matters.

Margibi J. Emmanuel Nuquay had requested that the ban on his travel to the US be lifted so that he could attend a meeting at the UN.

The U.S. government had imposed sanctions on Nuquay under Section 7031(c) of the State Department’s Foreign Assets Control Act. The act denies entry to the U.S. to foreign officials “for engaging in gross corruption by abusing their public positions through solicitation, acceptance, or giving of bribes to manipulate legislative processes and public funding, including legislative reporting and mining sector activity.”

The section provides that "foreign government officials and their immediate family members are not eligible to enter the United States if the Secretary of State has credible information that those individuals have engaged in substantial corruption or serious human rights violations 7031(c), (1) and (a) and 7031(c)(2)."

Under the same article, former Albanian Prime Minister Sali Berisha was also declared “persona non grata” by the US. The latter did not file a lawsuit in New York, but attempted to directly sue former US Secretary of State Antony Blinken in a Paris court. Two years ago, Berisha said that the Paris court had accepted his lawsuit, but since then, nothing is known about how the case has progressed.

"This designation is made pursuant to section 7031(c) of the Department of State, Foreign Operations, and Related Programs Act, 2021. In addition to Berisha, I am publicly designating his wife, Liri Berisha, his son, Shkëlzen Berisha, and his daughter, Argita Berisha Malltezi. These individuals are not eligible to travel to the United States," the State Department announced in announcing the sanctions against the Berisha family at the time.
