An appeals court is upholding President Donald Trump's birthright citizenship order, a decision that could take the case to the Supreme Court.

The court rejected an urgent request from the Department of Light to lift a judge's injunction blocking the implementation of Trump's executive order, saying it violated the Constitution.

In filings, the Justice Department said the birthright citizenship executive order was "an integral part of President Trump's broader effort to overhaul the United States immigration system and address the ongoing crisis at the southern border."

For decades, under an 1868 constitutional amendment and a statute that preceded it, citizenship has been extended to anyone born on American soil, regardless of their parents' immigration status. Trump is seeking to end birthright citizenship for children whose parents are either undocumented or legally present in the United States on temporary visas.

The case arose from a lawsuit filed by the Democratic attorneys general of four states, led by Washington. Their filings challenged efforts to create disputes about a president's powers in the area of immigration.
