The prosecutor of the Anti-Mafia Directorate in Bari, Francesco Giannella, gave an interview to journalist Thimi Samarxhiu on the show "Zona Zero" on Top News.
The Italian prosecutor has spoken about many topics, from problems with justice, relations between Italy and Albania, crime figures to drug trafficking
Interview
Mr. Giannella, thank you very much for finding time for this interview for Albanian television. It is an honor for us to have this interview with you.
- Thank you.
Then, let's talk about Albania, about the ties that Italy and Italians and Albanians have with each other, but we cannot avoid the ties of Albanian and Italian criminality. How have these relations changed over the years, between Italy and Albania?
I have been dealing for many years with the relations between Albanian criminality and organizations from Pulje, I have been following these stories for at least fifteen years or maybe even more. They have changed, in the sense that in the beginning these relations were much more, how can we say, more artisanal, and further developed more, because there has been an increase in Albanian and Italian criminal organizations in the world, not only in Italy, and in at this moment the relations are very close, there is not a relationship of subordination of one to the other, but it is a relationship of a common alliance, in a way. Pula is the first landing place, of course, of all large traffic, especially marijuana, coming from Albania, so it is clear that an agreement with the Pula organizations was necessary. But it is an agreement that sees these roles in evolution, not always constant. Regarding then the District of Bar, which includes the provinces of Bar, Tran and Foxha, there has been a shift from the south to the north of the landing points, because every time operations were developed to fight them, the leaders decided to change the route and go more and more towards the north. And so, Pulja started with the first landings of narcotics in Salento, then moved to the province of Bari, and then moved to the south of the province of Foxha, with the landings in the Gargano area. And then landings have been carried out all over the Adriatic coast, even in Marche, in recent years, so there is an ability to adapt on the part of the organizations, which, in fact, they have also devoted themselves to other things, over the years, they have developed their network, they started with heroin, in the two thousand years, let's say. And then, there was a huge increase in marijuana traffic, and there is also a big cocaine business, but it has a completely different path.
But when it comes to marijuana, it is said that those were golden years for criminals from Albania who brought marijuana, while now it is said to have decreased. Is it true or not that the amount of marijuana arriving from Albania has decreased?
Looking at our seizures, it seems so. There were years when we were seizing tons of marijuana, and then that trend kind of dropped off. While that of cocaine grew, which, of course, has nothing to do with landings, but which originates almost entirely from Northern Europe, Holland, let's say, or Spain, but as far as we are concerned, especially from Holland.
What about the connections of the Albanians in terms of the cocaine route, how are they, that is, are they still the ones who command, direct, this cocaine route?
Answer: In terms of relations with the Pulje clans, we can say that they have a slightly higher role, that is, they are the ones who manage the big traffic. But they also need points of reference in our territory, in terms of market management in the territory. And so, even during the development of other investigations, we have had reliable data in reference to the presence of Albanian subjects, starting from the Netherlands, and ending with cocaine traffic to Italy. We also had the case of a murder committed in Amsterdam, of an Italian by another Italian, in connection with cocaine traffic originating from Amsterdam, where the Albanian clans are involved, in some way, and, above all, Colombian ones, from the beginning.
I also asked this question to Prosecutor Cafiero De Raho and he told me yes. For you, does the Albanian mafia exist, as the term Albanian mafia, or is it organized crime?
We still do not have a process in which the criminal offense that we call 416 bis has been declared. There was an attempt, many years ago, to develop investigations of this type, but that did not yield results. Let's say that we now, from the point of view of certain judicial facts, consider the Albanian criminality as a criminality that is dedicated to the international traffic of narcotics, that is, the one that for us refers to Article 74.
Despite the articles, from what you see, it can be said that...
We can say it on the basis of a court decision. As long as we do not have a decision, we cannot say that Albanian criminality is of the mafia type. We cannot say that, nor can we rule it out.
Regarding the evolution of Albanian criminality, these days what is the biggest focus of Albanian criminality here in Bari, apart from cocaine, but prostitution still exists or not?
I don't deal with prostitution, let's say my sector doesn't deal with this issue, so I can't answer this question. As for Albanian criminality in Pulja, and in Bari in particular, it has always been dedicated to drug trafficking, but I repeat, in the double channel, marijuana from Albania and cocaine from Northern Europe. Evolutions have been followed especially in the investigations that we have developed with our Albanian colleagues, with whom we have several joint investigation teams, with which we try to follow the traffic routes directly from Albania, even before they arrive in Albania. And, in this sense, cooperation relations with SPAK are of fundamental importance. I would say that we have achieved extraordinary results during these last years.
Yes, there are at least three operations that I remember, PEAK, BOSS and SOUL. These are three operations, thanks to which many people in Albania and Italy have ended up in prison. But from all these operations, connections are noticed, because even a prosecutor was arrested in one of these operations. That is, the connections, from what you see and have archived, documented, the connections that corrupt policemen, corrupt prosecutors and others have, are they strong?
We have signaled to the Albanian authorities some things that had emerged during our investigations. We signaled to them, we sent them copies of the documentation, copies of the interceptions, which showed, so to speak, very serious suspicions against some persons who were supposed to represent the institutions. And then, on this, the Albanian judicial authorities proceeded, which acted. Therefore, we have noticed the existence of these connections, we have caught them in some way during our investigations, what happened will then be the duty of the judicial authorities to determine. So we expect to find out if our tests have subsequently given results in Albania, we cannot proceed in Italy with Albanian public figures, this does not happen. This happens in Albania, also thanks to our investigations,
But do you believe, in the sense that, I am asking you the question regarding the fact that you have sent the information, a few years ago the Prosecutor's Office was reluctant to send the information to Albania, as they were afraid that it would become public and those responsible ran away. Have you now established trust in the authorities in Albania?
Yes, a lot has changed in recent years. Relations with Albanian colleagues, with SPAK prosecutors, in particular, have become excellent, we work very well together. We hope we can continue to work like this. In the past there were some years when there was a great mistrust. It's a bit like what always happens in international relations between judicial authorities, in the beginning there is always a feeling of doubt, fear, different languages are spoken, not only at the linguistic level, but also precisely as different mindsets. And there were a few years when these relations failed to obtain results, on the contrary, sometimes we even had suspicions that the big traffickers, the big capos, were always able to get away with it, and of course there were doubts that there were corruption phenomena. , favoritism. Now things have changed, especially in the last three years, and the results are excellent. Of course, we must continue on this path. Fear, that is, the fear of corruption, always exists. But this exists in any country in the world, not that it can be different in Albania, it can be more or less. There may be a cultural maturity, a greater tendency towards legality, let's say, but democratic processes, processes of legality, are long processes.
It is the perception in Albania that, apart from SPAK, we expect great things from SPAK. Three years have passed and we have not seen a single corrupt politician arrested. And, from this side, that is, the people, see from you, from our partners, from Italy, from the United States, from our partners who help us, see the hope that you will help us, as in the case of operation SPIRIT, of the prosecutor shown there. They see from you the hope that corrupt characters can be found and exposed. Is this a responsibility for you?
Yes, yes, it is a responsibility, because meanwhile we are really very close, this fact that we are really very close, lo, so close to the sea, somehow makes us connected, eternally connected. We are very interested in the fact that in Albania there is a democratic development, a development of legality, which will lead us further in a common journey, perhaps in the framework of the European Union. We all wish that Albania succeeds in joining the European Union. And then, I believe that the future will be that Albania will walk on its own feet, that is, it will reach with its own forces and discover the corrupt characters and punish them. It will do this and, if necessary, we will continue to support this research with our investigations, but there will always have to be cooperation. Cooperation is made by people, institutions, as many say themselves, walk on people's feet. The people must be the right ones and must be those who have all the good intentions to cooperate and must be trusted. If this cooperation will continue, we will achieve great results, confidence will increase, even among the Albanian population, which I hope, after a few years, will no longer need either the Italians or the Americans to find its own corrupt people. I hope this happens as soon as possible. But to do this, you need the tools. If this cooperation will continue, we will achieve great results, confidence will increase, even among the Albanian population, which I hope, after a few years, will no longer need either the Italians or the Americans to find its own corrupt people. I hope this happens as soon as possible. But to do this, you need the tools. If this cooperation will continue, we will achieve great results, confidence will increase, even among the Albanian population, which I hope, after a few years, will no longer need either the Italians or the Americans to find its own corrupt people. I hope this happens as soon as possible. But to do this, you need the tools.
Means? What are the tools?
Tools are, above all, technological tools, for example. I know that in Albania, for example, there is a lack of tools to develop penetrating investigations, as well as to carry out wiretapping, environmental wiretapping, telematic wiretapping. Today, this investigative activity is of fundamental importance. Wiretapping serves almost no purpose anymore, let's be honest.
Ka programs...
There are programs, there are all social networks that can be used, even to conduct conversations. So, if the skills and technical possibilities to develop these investigative activities are not acquired, it cannot go in any direction.
And that is precisely why you enter the game, in the sense that the Albanians trust and hope in you. This is the point where you come into play.
And this has often happened, that is, by developing parallel investigations between us and you, we have often used our technologies, have more tools and managed to collect more evidence related to criminal offenses that have been committed in Albania. Through joint investigative teams, the work we do can be forwarded to Albania and vice versa, the work done in Albania can be used in us. But we would like an economic effort to be made on the other side of the Adriatic, precisely, to invest more in investigative technology, in the preparation of the police, in the subordination of the judicial system and the police.
Here, let's stop a bit, on the subordination, because there is a lot of talk about the pressure, the influence that politics has on judges and prosecutors. How can this end, how can the influence of politics on prosecutors be avoided?
Duhet pasur ky guxim, duhet pasur ky guxim.
Yes, finding the right person is not an easy thing, but if they look, newspapers, journalists, have a great task, a great mission, which is to give a voice to those who have no courage. So, you can do a lot. So you, who represent those people who do not have the power to speak, you can do this, you can do a lot in this sense.
Mr. Prosecutor, thank you very much! It was an honor, a privilege to be able to speak with you.
Thank you!
