Tenders, the new law enters into force. What are the main changes for economic

From March 20, the tenders will be developed based on the new rules, which provide for the recently approved legal changes. The Public Procurement Agency has notified all contracting authorities, but also economic operators about the innovations brought by the law, requesting their implementation.

One of the main changes is related to some additional conditions on the exclusion of operators if they are not fulfilled. More specifically, economic operators will be disqualified from the competition if they do not have beneficial owners registered in the register of beneficial owners.

Also, they are excluded from the competition when they do not fulfill the obligations arising from the legislation on salaries or when the person convicted by a final court decision for a serious professional offense is a member of an administrative body, its manager or supervisor, a shareholder or partner, of the economic operator, or has representative, decision-making or controlling powers within it.

At the same time, according to the new law, the submission of complaints and arguments by economic operators will be done in the Electronic Complaints System. The new law revises the obligations of contracting authorities or entities towards PPA, for reporting on the implementation of contracts, removing the obligation to report on the drafting of the contract implementation plan, as well as interim reports on the progress of the implementation of the contract.

With the legal changes, a single report is foreseen at its conclusion. On the other hand, the revision of the Conflict of Interest article has been made, also foreseeing the case of taking measures in case of its identification during the implementation of the contract. According to APP, the purpose of this law is to improve the regulatory framework of public procurement in Albania, aiming for further alignment with EU directives.
