At the peak of the tourist season, the hotels in the tourist areas of South and Durrës have been asked again by the National Water and Sewerage Agency (AKUK) through a notice, the obligation to install plants for the treatment of polluted water.

The sending of notices to tourist operators comes after the campaign undertaken to place identification signs with a red circle in front of businesses that have not installed plants that cost up to 100,000 euros.

"Dear tourist operator,

Following the awareness initiatives that we have undertaken so far with all interested parties, we would like to emphasize once again the importance of implementing the obligations derived from Normative Act no. 8 and the Technical Regulation "On taking urgent measures for the protection and improvement of infrastructure, for the treatment of polluted waters that are discharged near or in washing waters".

The main purpose of this act is to achieve the objective of 95% of washing water in "excellent" quality, ensuring a clean environment and improving the quality of life for our citizens", the distributed announcement emphasizes.

In this context, it is stated, among other things, that "the involvement of the tourism industry in the process before the treatment of polluted water, through the installation of individual systems, will help not only in the protection of the environment and public infrastructure, but will also set a standard of new in the quality of bathing water, as one of the main sources of tourism development.

But businesses are concerned even at the start of the tourist season that the installation of the required plants costs between 80 thousand and 100 thousand euros. They claim that the cost of installing the plant is unaffordable, in the conditions when even the tourist season was lukewarm and that they pay the tax for the treatment of polluted water.

Regarding the high cost, in the notices sent to businesses AKUK states that the costs for plants can be transferred to services and products.

"Referring to the annual report of the European Environment Agency for the 2022 tourist season, the quality of bathing water in Albania was classified in the "excellent" category at only 67.5%, bringing the need for immediate and effective measures to improve the quality of bathing water .

The process of improving the infrastructure for the treatment of polluted water is an investment, the cost of which is transferable to the services and products you offer, thereby influencing the reduction of financial effects", the announcement emphasizes, among other things.

The chairman of the association of Bars and Restaurants, Enri Jahja, said that this is an arbitrary practice, since businesses are being asked to pay twice for the same service.

"First, businesses pay the water utility for the removal of polluted water and this has a value on the bill. Secondly, all over the world, these plants are installed by water utilities or, if financed by businesses, are exempt from tax liability. The state has issued an arbitrary normative act with the aim of collecting taxes arbitrarily, without discussion with the interest groups", he asserted.

Therefore, in the notice sent to businesses AKUK says that Normative Act no. 8 dated 28.12.2023 did not come as a separate initiative, but relies on the environmental legislation in force, specifically on law no. 9115, dated 24.07.2003 "On environmental treatment of polluted waters", amended which deals specifically with the obligations according to industry sectors for the pre-treatment of polluted waters. "Strengthening measures to improve the quality of washing water remains a common challenge for further social and economic development", concludes the announcement.

After the publication in the Official Journal on January 5, 2024 of the Normative Act "On taking urgent measures, for the protection and improvement of the infrastructure, for the treatment of polluted waters that are discharged near or in washing waters" the Minister of Infrastructure and Energy Belinda Balluku and the Minister of Mirela Kumbaro of Tourism and Environment signed on February 2, 2024, the joint instruction that defines the technical standards that must be followed by entities near coastal, lake and river areas, for the replacement of skeptic pits with the installation of modern plants for the treatment of polluted water.

According to the joint instruction, businesses were given a deadline until the end of March to install the specified equipment or systems or vice versa, as defined in the Normative Act if the Task Force, after carrying out the monitoring and inspection, when it finds that the plant or system is not installed individual in accordance with the technical rules for the treatment of polluted water, businesses will be punished with fines ranging from 1,500,000 ALL to 2,650,000 ALL.
