
If there is a case that clearly illustrates the difference between criminal prosecution in Albania and the standard of a European system like the Italian one, it is precisely the case open in the Court of Verona, where an Albanian prosecutor of SPAK is even facing defamation claims related to a request for international legal assistance.
The difference is huge. In Albania, it is enough for an unsubstantiated claim to come from SPAK and it is treated as proven truth. In Italy, the same claim is considered simply slander. The person harmed by this slander seeks and is offered legal protection. Our victims are simply offered detention and seizure of property.
Big difference, right?!
What is the case in the Verona court?
SPAK, under the signature of Prosecutor Dumani, is requesting legal assistance from Italy to seize some properties there linked to the Çela family. According to SPAK's claims, the seizure should have been made on the grounds that they stemmed from criminal activity. At first glance, a routine procedure of international legal cooperation.
But the story, according to these claims, took a completely different turn. After the Italian authorities verified the documentation and heard the owners' explanations, the same Italian prosecutor who requested the seizure, after only a month, concluded that the assets were not unjustified and requested the lifting of the seizure measures.
Subsequently, the Çela family (the company they own) filed a defamation lawsuit, claiming that the Albanian request had caused significant economic damage due to unfounded claims.
This is where the big difference between the two systems begins.
In Italy, the fact that a prosecutor has made a claim does not exempt him from judicial review. On the contrary, if it is alleged that he has exceeded the limits of the law or presented false facts, he himself becomes the object of judgment. No one enjoys immunity from the truth. No public office is a shield from defamation.
If you compare this with the Albanian reality, the contrast is shocking.
Before the GJKKO, with the same unverified data as true, SPAK prosecutors wreak havoc by arresting people and seizing property.
In our Criminal Procedure Code, very often the charges are not proven; but it is enough to prove the existence of the charge. Instead of the prosecutor demonstrating with evidence every element of the criminal offense, a police report, a fragment of communication, an interpretation of a conversation or an investigative hypothesis is often enough to be considered “reasonable suspicion”.
Then there is the arrest or seizure for the sake of "punishment." The phenomenon then becomes more dangerous: the suspicion is prolonged over time and, after being decided by the "people's courts" of the media, the initial suspicion begins to be treated as evidence.

Ku janë gjurmët materiale?
Ku janë provat shkencore?
Ku janë dëshmitarët okularë?
Ku janë pamjet filmike?
Ku është lidhja logjike mes një bisede dhe një ngjarjeje konkrete kriminale?
Këto pyetje mbeten pa përgjigje, sepse mjafton që pretendimin ta ketë shkruar SPAK-u.

Kjo është arsyeja pse rasti italian meriton vëmendje. Jo sepse provon automatikisht fajësinë e kujtdo, por sepse tregon një filozofi krejt tjetër të drejtësisë: pretendimi i prokurorit nuk është automatikisht provë; ai është vetëm një pretendim që duhet provuar.
Në Shqipëri, për fat të keq, duket se shpesh ndodh e kundërta. Pretendimi i prokurorit trajtohet si provë derisa i pandehuri të arrijë të bindë gjykatën për të kundërtën.
Ec e binde gjykatën e cila nga ana e saj i bindet SPAK-ut!

Po që prokurorët tanë kanë fuqi provuese ekstraterritoriale..!
Ata akuzojnë me dyshime e përgjime edhe shtetas shqiptarë për vepra penale të dyshuara në Itali e gjithandej, pavarësisht se në këto vende shqiptarit të akuzuar këtu nuk i hyn gjëmb në këmbë.
E pra askund në perëndim nuk ndodh kjo, që shtetet të akuzojnë shtetasit e tyre për dyshime veprash në vendin tonë. Kjo nuk ndodh jo për patriotizëm, por për fuqi provuese. Askund nuk të ndjekin penalisht pa një pasojë penale që provohet se ti ke lidhje me të. Dhe fjala nuk është provë, por kur keqpërdoret quhet shpifje.
Ama pandëshkueshmëria te ne është me efekte ndërkombëtare. SPAK-u ynë është si gjykata e Hagës.
Po ja ku vjen ky rast nga Italia që e bën një prokuror “të fortë” këtu me fuqi magjike provuese të llafeve, që të kërkojë për vete të mbrohet me avokat për këto llafe, sepse në Itali normalisht quhen shpifje jo prova.
Kam idenë se ka shumë që fërkojnë duart nga kjo situatë. Sa më takon, nuk tëzohem për diskretitimin e asnjë prokurori shqipëtar, përfshi dhe Dumanin. Nuk fërkoj duart, por vë duart në kokë nga mjerimi i sistemit të drejtësisë që kemi. Për cilësinë e keqe dhe shumë të keqe të të bërit drejtësi.
Kemi një sistem që e ngatërron dyshimin me provën. Që e konsideron sekuestrimin si dënim paraprak. Që e sheh paraburgimin si mjet presioni dhe jo si masë përjashtimore. Që i jep prokurorit një autoritet pothuajse të pakontrollueshëm, ndërsa gjykata shpesh kufizohet në vulosjen e kërkesave të tij.
If the Italian justice system holds even one prosecutor accountable for the claims he makes, the Albanian justice system should ask itself why it still continues to take SPAK's claims for granted without first going through the rigorous filter of evidence, truthfulness, and legality.
Because in a state of law, decisions are not built on conviction or institutional reputation. They are built only on evidence, which is taken strictly in the manner dictated by the law. Where evidence and its legitimacy are lacking, there should be neither conviction, nor seizure, nor destruction of anyone's life.
