When more than a year has passed since the 1-year deadline given by the Constitutional Court to politics to guarantee the vote of immigrants, President Holta Zaçaj said that there was no legal mechanism to force political parties to implement such a decision as it is a legal obligation and its non-implementation could not be imagined. Zaçaj was asked today about the decision of the institution she leads on the issue of Olta Xhaçka's mandate.
"Questioning the implementation of the decisions of the Constitutional Court is unthinkable in a legal state. Having the form of law and not having any equivocation not to be implemented, the Constitutional Court has no mechanisms to control the applicability of the decisions.
"What I want to emphasize is that if I can give it as a message for politics, it is that the implementation of the decisions of the CJK is the right, necessary and only way. There is no other way of behavior if we want to be institutions of a legal state that is guided from the principle of democracy.
It does not have an expected legal effect because such a thing is not imagined to happen. There are no mechanisms that can be set in motion in case a decision of the Constitutional Court is not implemented. The decision of the CJK is law and for this reason there are no mechanisms" - said Zaçaj.
The Constitutional Court overthrew the Assembly for Xhaçka and accepted the lawsuit of the Alibeaj group declaring as unconstitutional the decision of the socialists not to bring the legitimacy of the deputy's mandate to the Constitutional Court.
