"Hysa brothers shpk" were behind every tender of "Sulova Construction Production", the two well-known businessmen are sent for trial!

The Prosecutor's Office of Tirana has closed the investigations and has sent the case to trial against Elton Musta and Agron Hysa as well as the two companies " Sulova Construction and Production " and " Vëllezërit Hysa " for the criminal offense of "Forgery of documents".

From the conducted investigations, it turned out that Elton Musta formally created the company " Sulova Construction Production " on June 27, 2014, while he continued to be employed by the company "Vëllezërit Hysaj" shpk .

The investigation proved that the company "Sulova Construction" was nothing but a creature of the company "Vëllezerit Hysa" which was used by the latter for the purpose of participating in procurement procedures not in its name but in the name of the company "Sulova Construction Production" .

Musta and Hysa, according to the Prosecutor's Office, are suspected of having consumed the elements of the criminal offense of "Forgery of documents", carried out in cooperation, since they submitted false data in the procurement procedure regarding the participants and real beneficiaries of this procurement procedure .

The investigation showed that the presentation of the company "Sulova" or even "IRCOP" Albania branch, in the procurement procedure is merely a formal action since in reality the company "Vëllezërit Hysa" was hiding behind them.

Announcement of the Tirana Prosecutor's Office:

The Prosecutor's Office at the Court of First Instance of the General Jurisdiction in Tirana completed the investigations and sent to trial the citizens EM, AH and the companies "Sulova Ndretim Uzman" and "Hysa Brothers" for the criminal offense of "Forgery of documents" carried out in cooperation, provided by Article 186/2 of the Criminal Code.

From the investigations carried out within the framework of criminal proceedings no. 207, dated 26.09.2019 for the criminal offenses "Abuse of duty", "Violation of the equality of participants in public tenders or auctions", "Passive corruption of persons exercising public functions" and "Forgery of documents", provided by articles 248, 258, 186 and 259 of the Penal Code, resulted in the EM citizen having formally created on 06/27/2014, the company "Sulova Construction Production" while continuing to be employed at the company "Vëllezërit Hysaj" shpk.

The investigation proved that the company "Sulova Construction" was nothing but a creature of the company "Vëllezerit Hysa" which was used by the latter for the purpose of participating in procurement procedures not in its name but in the name of the company "Sulova Construction Production" .

Citizens EM and AH are suspected of having consumed the elements of the criminal offense of "Forgery of documents", carried out in collaboration, provided for by Article 186/2 of the Criminal Code, since they submitted false data in the procurement procedure regarding the participants and the true beneficiaries of this procurement procedure. The investigation showed that the presentation of the company "Sulova" or even "IRCOP" Albania branch, in the procurement procedure is merely a formal action since in reality the company "Vëllezërit Hysa" was hiding behind them.

Likewise, the legal entities "Sulova Construction Production", with NUIS L43027201P and "Vëllezërit Hysa" shpk, have consumed the elements of the criminal offenses provided by articles 186 and 25 of the Criminal Code. Regarding these investigated persons, with the decision dated 08.11.2022, the Special Prosecutor's Office has decided to separate the acts and continue the investigations in a separate criminal proceeding.
