The elected mayor of Himara, Fredi Beleri, has appealed the decision of GJKKO that sentenced him to prison for buying votes.

Fredi Beleri , who was arrested on May 12, 2023, submitted the file to the Appeal of the Special Court on Friday (May 3) and the lot is expected to be drawn to determine the jury.

The elected mayor of Himara was found guilty on March 5 of vote buying and was sentenced to two years in prison by the Special Court for Corruption and Organized Crime.

While his accomplice, Pandeli Kokaveshi, was sentenced to three years of probation. This relief measure for Kokavesh was given as he has health problems, as well as his minor child has health problems.

According to GJKKO, the sentence for Fredi Beleri starts from the day he was arrested, i.e. on May 12, 2023.

According to the calculations, the elected mayor of Himara had 1 year and 3 months left in prison. GJKKO says that he will serve the sentence in a regular security prison.

Fredi Beleri has been in custody since the May 2023 elections, which means that he has about 9 months of his sentence left to serve in the cell. This is because detention days count as a day and a half in a normal prison cell.

DECISION OF GJKKO:

The Special Prosecutor's Office against Corruption and Organized Crime on 31.07.2023 submitted to the Court the request with the object: Sending for trial the criminal case in charge of the defendants Dhionisios Alfred Beleri and Pandeli Kokaveshi accused of the criminal offense "Active corruption in elections" " carried out in cooperation provided by articles 328 - 25 of the Criminal Code.

The trial of this case took place with the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judges Erjon Çela, Irena Gjoka and Flora Hajredinaj, with decision No. 14, dated 05.03.2024 decided:

The guilty plea of ​​the defendant Pandeli Kokaveshi, for the commission of the criminal offense "Active corruption in elections" carried out in collaboration, provided by articles 328 - 25 of the Criminal Code and based on these provisions, his sentence of 1 (one) year and 6 (six) months imprisonment.

Në aplikim të nenit 59 të K.Penal urdhërohet pezullimi i ekzekutimit të vendimit të dënimit me burgim, për pjesën e mbetur pa vuajtur të tij, duke e vënë të pandehurin Pandeli Kokaveshi ne provë për një periudhë kohe prej 3 (tre) vjetësh, me kusht që gjatë kësaj kohe të mos kryejë vepër tjetër penale si dhe të mbajë kontakte të rregullta me Zyrën e Shërbimit të Provës ku ka vendbanimin e tij.

Në zbatim të nenit 261/1 shkronja “b” të K.Pr.Penale, shuarjen e masës së sigurimit personal “Detyrimi për t u paraqitur në Policinë Gjyqësore” e caktuar ndaj të pandehurit Pandeli Kokaveshi me vendimin Nr. 19, dt. 01.06.2023 të Gjykatës së Posaçme të Apelit për Korrupsionin dhe Krimin e Organizuar.

Deklarimin fajtor të të pandehurit Dhionisios Alfred Beleri, për kryerjen e veprës penale “Korrupsioni aktiv në zgjedhje” kryer në bashkëpunim, e parashikuar nga nenet 328 – 25 të Kodit Penal dhe në bazë të këtyre dispozitave, dënimin e tij me 2 (dy) vite burgim.

Vuajtja e dënimit për të pandehurin Dhionisios Alfred Beleri, fillon nga dita e arrestimit të tij dt. 12.05.2023 dhe të kryhet në një IEVP, burg i sigurisë së zakonshme.

Në zbatim të nenit 190/1 gërmat “a” dhe “ç” të K.Pr.Penale, në lidhje me provat materiale të sekuestruara për llogari të këtij procedimit penal, Gjykata disponon si më poshtë :

Një CD-R Maxell mbi të cilën është shënuar me shkrim dore “Komisariati Himarë Dt. 10.05.2023”, një DVD-R mbi të cilën është shënuar shkrim dore “Komisariati Himarë Dt.11.05.2023”, DVD+RË” EMTEC, mbi të cilën është shënuar me shkrim dore “Proc. Nr. 489 dt 08.09.10.11 i 5 – 2023 Himarë. Vlore, të qëndrojnë në dosje.

8 (tetë) karmtonedha të prerjes 5.000 lekë, të konfiskohen dhe kalojnë në favor të shtetit.

Pajisje DVR e markës “Dahua”, numër serie SN 6J001308PA213DF64, sekuestruar shtetases Ermira Stoli, ti kthehet kësaj shtetaseje.

Aparat celular i llojit “Iphone 11 Pro Max”, ngjyrë e zezë, me veshje të jashtme plastike të kuqe, në gjendje të fikur, me IMEI: 352843111503600, i përdorur nga dëshmitari Arsen Rama, ti kthehet ketij shtetasi.

Procedural costs during the investigation phase in the total amount of 166,920 (one hundred and sixty six thousand nine hundred and twenty) ALL as well as court costs, according to the relevant form, are charged to the defendants, jointly and severally.

Against this decision, an appeal can be made by the parties within 15 (fifteen) days to the Special Court of Appeal for Corruption and Organized Crime, which period starts from the day after the announcement of the decision.
