'Durana' should have been a park as stated in Law No. 58/2022 "On the Creation, Organization and Functioning of Technological and Scientific Parks", one of the important efforts of the Albanian state to create a sustainable ecosystem of innovation, technology and scientific research.
Albania already has this park, albeit virtually with 53 companies, part of "DURANA", but SPAK has launched investigations, after links were found between corruption in the National Agency for the Information Society and this platform.
In this case, it is not about tenders, but about taxes, allowing companies registered in the park to benefit from fiscal incentives that would come into effect for them from January 1, 2025.
This would be the first favor for 'Durana', 0% profit tax for a 15-year period for income generated from activities that take place in the park.
The problem lies in the fact that the companies registered in Durana belong to businessmen like Ermal Beqiri, Ergys Agasi, etc...same company, but a changed name with the same function. Is this allowed? What does Albanian law say?
The 2022 law, in its point 12, clearly states that the transfer of an existing activity on Albanian territory to the park, with the main purpose of benefiting from the facilities provided for in this law, is prohibited. Another draft law with amendments has been provided for this point. This law prohibits a business or partnership from reinventing itself under another name but with similar activity only to escape fiscal obligations.
At this point, a draft law proposed by socialist MP Ramion Kurti, already passed for consideration in Parliament for several additions to the law on "Technological and Scientific Parks", provides for two important changes that directly affect the country's only technological park, which is Durana. Specifically, in the letter (dh), at the end of the paragraph, the sentence "The resident user of the park is registered in the territory of the park with a primary NIPT/NUIS or/and with a secondary NIPT/NUIS in territories different from the territory of the park."

This change essentially stipulates that park users can have two grandchildren. One inside the park and one outside the park, but enjoying the park's privileges. This change is an open door for entry into Durana to be only formal, while the activity continues outside the park.
Another amendment prepared in parliament concerns the benefit of public money. More specifically, Article 5 of the same law stipulates that park companies can sell products produced in the park to public entities or joint ventures at a lower price.
“(c) preferentially benefit from goods/services/creations/products produced in the park by a user whose shareholder is a public entity or a joint venture/joint venture with a public entity at a preferential price provided for in the "Cooperation Agreement for an Innovative Product" based on the standard model contract approved by Decision of the Council of Ministers. (ç) conclude cooperation agreements for an innovative product with users whose shareholders are one or more public entities, including the developer, regarding their goods/services/innovative products/creations in the park.” - states the draft law submitted to the Assembly, which in a broader sense would pave the way for Durana members to enter into public tenders in the field of technology in the future.
So far, public money has not been affected. None of the 'Durana' companies have carried out any economic activity, even virtually, from January 1 to January 15. Will there be a development of this sector after the proposed draft laws? It remains to be seen!/ zëri.ai
