In the trial against the former head of ARRSH, Sonila Qato, a former employee of the company "Vëllezërit Hysa" admitted that they had negotiated with the Italian company and that they were behind the tender worth 19 million euros for the construction of the tunnel on Kardhiq- Delvina.

Nine of the ten witnesses called in the judicial process to be questioned in the function of the criminal case in charge of the former director of the Albanian Road Authority, ARRSH, Sonila Qato, as well as other officials of this institution, presented on Tuesday, October 10 in to the Special Court of the First Instance, their statements regarding the circumstances established by the investigation.

Qato and her subordinates are accused by the Special Prosecutor's Office, SPAK, of favoring a shadow company for the tender of the Skërfica tunnel on the Kardhiq - Delvinë road. The company "Sulova Construction Production" part of the union of operators that was initially ranked first, is estimated by SPAK to have been formally created to represent the interests of the company "Vëllezërit Hysa" in this tendering procedure, which according to the accusation was the real winner predetermined by the leaders and officials of ARRSH. Qato and her subordinates have denied the charges.

According to the Prosecution, Agron Hysa first went to Italy and asked the company "IRCOP Italia" to participate in this procurement procedure, accompanied by the employee Joana Myzeqari.

Present in court as a witness on Tuesday, Myzeqari confirmed that there had been communications with IRCOP regarding this procurement procedure. Myzeqari stated that he worked in the "Hysa Brothers" company during the period 2017-2019 and that he dealt with administrative issues.

In response to the question of prosecutor Elvin Gokaj, if she knew the Italian company IRCOP, Myzeqari stated that there had been communications. She explained that she had the task of finding a cooperating company for a tender.

According to the witness, she once traveled to Italy to meet with "IRCOP...", together with the administrator of the company "Vëllezërit Hysa", Agron Hysa, and once she went alone. Myzeqari stated that they had submitted to "IRCOP..." the tender documents for the Kardhiq-Delvinë road.

Myzeqari was also asked by Qato's legal representative, lawyer Vladimir Meçe, about her duties with the company "Vëllezërit Hysa. She stated that she was involved in projects and played the role of coordinator, but that she had not seen what position was written in the employment contract.

Meçe directed the questions to the witness to the same microphone that she gave the answers, which brought the intervention of the judge Irena Gjoka. "It seems like you intimidate him," Gjoka said, as he asked the lawyer to use the other microphone.

Even in response to the questions of lawyer Meçe, the witness Myzeqari confirmed that she had gone to meet the representatives of "IRCOP..." and that she had once been together with Agron Hysa.

She clarified that initially about 100 companies were contacted, some of which did not respond and that in the end they agreed with "IRCOP...".

Meçe continued with quick questions, insisting that the witness give an answer about how she got the tender documents. When she was answering, he addressed her saying: "Ignorant dog".

The presiding judge, Irena Gjoka, drew the attention of lawyer Vladimir Meçe again and he stated that he retracted what he said about the witness.

Among the witnesses who gave statements was Elton Musta, the administrator of the company "Sulova Construction and Production", which was allegedly created by the Hysa brothers to be represented in the said tender.

Musta stated that he works as an economist at the Hysa brothers, while clarifying that he had been an administrator and sole partner at the company "Sulova Construction and Production". He claimed that he had paid off the company's obligations from the income from the work he had done in that period. Musta said that he had rented tools from the company "Vëllezërit Hysa" and had also given them tools against rent.

ARRSH employees and representatives of several companies also gave summary evidence, while the prosecutor Elvin Gokaj asked for more time to prepare the questions for the witness Rrok Gjoka, the administrator of "Gjoka Konstruksion" who accused Qato of having manipulated the tender procedures by favored one of the mergers of competing operators, which had an offer about 4 million euros higher. In the end, "Gjoka Konstruksion" was declared the winner of that tender and carried out the works.

Gokaj's request was accepted and it was decided that Gjoka will be questioned in the next session.

At the beginning of the session, the legal representative of the defendant Simon Prendi, lawyer Antoneta Sevdari, presented a request for evidence. She asked the court, among other things, to administer, in the form required by the law, a letter that "Gjoka Konstruksion" had addressed to ARRSH for additional funds. According to her, Gjoka Konstruksion itself noticed that the tunnel was longer than it had anticipated when it competed and requested additional funding.

The court stated that the defense of the defendant Prendi had to first prove that it was objectively unable to provide this document in the form required by the law, and then the court's investment could be requested.

In conclusion, the court decided to postpone the hearing to October 24, at 09:00, when 10 other witnesses will be questioned besides Gjoka./ BIRN
