Assets established by crime and corruption will no longer be able to avoid confiscation by justice, being sold or donated to persons who are not related by blood and are not affected by the Anti-Mafia law.

The draft provided by the show "FactCheck" has introduced the innovation of confiscation to third parties, calling their forgiveness or sale below the real market value as an illegal action.

Albania currently has the Anti-Mafia law, a law to which the assets of the underworld or those associated with them are subject. Among them are the close ties of family, blood or blood. For the first time, the new criminal code under discussion introduces the concept of confiscation to third parties under Article 74.

What does this article say?

1. Products or other assets whose value corresponds to these products, which have been transferred to third parties by the perpetrator of the criminal offense, or which third parties have purchased directly or indirectly from the perpetrator, are also subject to confiscation, provided that third parties knew or should have known that the purpose of the transfer of ownership or purchase was to avoid confiscation, based on concrete facts and circumstances, as well as when the transfer or purchase was made for free or against a high value times smaller than the market value.

2. The same measure is also imposed on items or property that derives from the commission of a criminal offense, is a product or means of its commission, when they are found in the hands of third parties for any reason.

3. Confiscation according to the first paragraph of this article does not affect the rights of third parties who are in good faith.
