LATEST NEWS/ SPAK takes the judge of Elbasan, Zamira Vyshka, to trial

SPAK has closed the investigations and brought the case to trial against Elbasan judge Zamira Vyshka, lawyer Ilir Pashaj and other defendants.

Judge Vyshka was arrested in July by order of SPAK, together with lawyer Ilir Pashaj, as she was taking bribes of about 400,000 lek, to reduce the sentence of a prisoner by 6 months.

The Special Prosecutor's Office against Corruption and Organized Crime has completed the investigations of criminal proceedings no. 209 of 2021, for the criminal offenses of "Active corruption of judges, prosecutors and other officials of justice", in cooperation, provided by articles 319 and 25 of the Criminal Code, "Passive corruption of judges, prosecutors and other officials of judicial bodies", provided by articles 319/ç of the Criminal Code, as well as "Crime prevention", provided by article 300 of the Criminal Code.

The investigated criminal fact is related to a case of active/passive corruption in the justice system (in the city of Elbasan), where interested persons/family members of an arrested citizen in cooperation with the defense lawyer, have offered the judge of the case an amount monetary with the purpose of favoring the determination of the punishment measure.

After analyzing the evidence gathered in this criminal proceeding and the completion of the investigation, the Special Prosecutor's Office addressed the Special Court of First Instance for Corruption and Organized Crime with a request to send the case for trial to the charge of the defendants:

Zamira Vyshka, accused of committing the criminal offense of "Passive corruption of judges, prosecutors and other officials of justice bodies", provided by article 319/ç of the Criminal Code.

Ilir Pashaj (lawyer), Taulant Ramollari and Xjulio Musaj accused of committing the criminal offense of "Active corruption of the judge, prosecutor and other justice officials", carried out in cooperation, provided by articles 319 and 25 of the Criminal Code. Andrea Tirana, accused of committing the criminal offense of "Discrediting the crime", provided for by Article 300 of the Criminal Code.

We remind you that SPAK's interceptions and observations revealed judge Zamira Vyshka and lawyer Ilir Pashaj, who were arrested for bribery and corruption in Elbasan. In the intercepts, it is added that the arrested Xhulio Musaj, accused in 2019 of theft, asked for a reduced sentence of 6 months in prison.

Familjarët ofruan shumën 200 mijë lekë me negociator avokatin Ilir Pashaj, ndërsa gjyqtarja kishte kërkuar dyfishin, pra 400 mijë lekë. Ata ishin të gatshëm të jepnin paratë e kërkuara për të lehtësuar masën e sigurisë ndaj Xhulio Musajt, por me fryrjen e shumës nga gjyqtarja, nuk kishin pranuar. Nga përgjimet ka rezultuar se familjarët e të arrestuarit i kanë thënë avokatit: "Më mirë t’i hajë ai 400 mijë lekë në burg se sa gjyqtarja."

Zamira Vyshka është një emër i lakuar në sistemin e drejtësisë.  Ish-shefi i policisë rrugore Elbasan, Fadil Mema, para se të ekzekutohej në Itali në 14 mars 2015, ka rrëfyer ndër të tjera para prokurorit të ndjerë Xhevat Hana se gjyqtarja Zamira Vyshka ishte mikeshë e grupit Çapja në Elbasan dhe se merrte vendime për llogari të tyre.
