After the Special Court ordered SPAK to register criminal proceedings against former minister Olta Xhaçka and her husband Artan Gaçi, the prosecution appealed the decision to the Special Anti-Corruption Appeal.

The Special Prosecution Office says that it has carried out numerous investigative actions, which have consisted, among other things, of the activity carried out by citizen Artan Gaçi in the context of the alleged collaboration or even his knowledge of the existence of forged documents, through which land of the type "truall" was obtained.

The prosecution, among other things, explains that no data on specific areas has resulted in the acquisition of lands seized or confiscated due to the duties performed by the special subject Olta Xhaçka at that time.

In the appeal that SPAK has filed in the second instance of the judiciary, it states that the case previously investigated by the prosecution has passed through the filter of the special court during the trial of criminal case no. 189/2023 in the preliminary hearing.

Moreover, prosecutor Ols Dado adds, the special court has exercised jurisdictional control, deciding to transfer the file against Jorgo Goro for trial, accepting the prosecution's request, after assessing that the evidence was sufficient to support the accusation.

According to Dado, the Court has not found any reason, especially those presented by the complainant citizen Fredi Beleri, to conclude that the preliminary investigations were incomplete, consequently ordering their completion.

In the prosecutor's reasoned decision not to initiate investigations, it is clarified that the criminal proceedings against Jorgo Goro did not lack judicial control, either during the preliminary investigation or during the trial in the preliminary session.

The Special Prosecution Office states that the decision of the GJKKO is unfounded in law and evidence, vulnerable, and as such should be changed in its entirety.

On February 28, the GJKKO ordered SPAK to investigate Artan Gaçi for committing the criminal offenses of "Forgery of documents", "money laundering" committed in collaboration and Xhaçka for "abuse of office". 

The court's decision came after an appeal filed by former Himara mayor Fredi Beleri, who requested that Xhaçka and her husband be investigated regarding the complaint he previously filed against Jorgo Goro, who has been held in prison since March 2023.

The Appeals Court hearing will be held this Friday, as SPAK's appeal will be reviewed by Judge Ilirjana Olldashi, who will either accept Prosecutor Dado's request or leave in force the first instance decision to launch investigations.
