A three-week-old baby was left without a mother by the decision of the Tirana court... Diana Bahçja, 27 years old from the village of Drisht in Shkodra, became a mother for the second time in her life on February 25 of this year.

But, while she was taking care of the child in the cradle, eight days after she gave birth, in the apartment of her husband, Nazmi, a court decision arrived, which sentenced the expectant mother to 1 month and 20 days in prison...

According to the court's decision, taken on June 13, 2022 by judge Ardiana Bera at the request of prosecutor Endrit Bimi, citizen Diana Bahçja will serve a prison sentence after not paying a fine of 250,000 ALL.

This fine was imposed on Diana Bahçe in 2020 by the court, on the charge of child abandonment. Diana's husband denounced the shocking event to the media on Tuesday, showing how his wife was sent to prison, just eight days after giving birth to a child.

But how does the dramatic story of mother Diana Bahçja stand?

More than 9 years ago, when Diana was still a minor, around the age of 17, Diana gets married. A few months after her first marriage, Diana gave birth to a daughter. But, eight months after she gave birth to her daughter, Diana divorced because her husband was constantly violent. Diana Bahçja herself testified to this for Syri Television, during a telephone conversation from the women's prison in Tirana.

However, the ex-husband did not stop only with the violence against Diana, but also accused her of child abandonment. Therefore, in 2020, Diana was fined by the court with 250,000 ALL, while as Diana herself says, she was never informed about this decision by the court.

As a number of institutions seem not to have implemented the law, two years after the fine was not executed, the court, at the request of the prosecution, converted the fine into a sentence of 1 month and 20 days in prison. Even for this decision, which was taken on June 13, 2022, when Diana was at the beginning of her second pregnancy, she and her current husband were not informed.

Eight days after she gave birth to the child, the local policeman in Drisht went to the Bahçja family's apartment, asking the expectant mother to appear at the police station to sign some papers, but without telling her that she would go to prison. Diana's husband, Nazmiu, says that after they presented themselves to the police, even though they refused to sign the papers, his wife did not return to the apartment, but was taken to prison.

Ky vendim i marrë nga Gjykata e Tiranës, duket se është ekzekutuar në shkelje të Kodit Penal.

Sipas nenit 34, paragrafi i fundit i Kodit Penal, përcaktohet qartë se nëse kur e dënuara është shtatëzanë apo me fëmijë nën 1 vjeç, dënimi shtyhet derisa fëmija të bëhet një vjeç.

Diana Bahçja is a pregnant mother, harmless to the community, but it is inexplicable why justice has been rushed to imprison a 27-year-old, when in her conditions, mitigating measures, provided for in the law, could be given.

It is now up to the president to apply the pardon for Diana, as well as the responsible institutions, to investigate possible procedural and legal violations in the punishment of a mother who does not pose a danger to the community.

This is the story of Diana Bahçje, told to Syri.tv, who "abandons" her babies for the second time. The first time because of violence from her ex-husband and the second time from justice... In both cases, not Diana's fault...
