The Supreme Court has rejected the appeal and upheld the conviction of two doctors, Elona Burba and Petrit Rexhepi, who were found guilty of "negligent treatment" to the detriment of Dorjana Haka, the wife of former goalkeeper Alban Hoxha.

Burba was sentenced to 1 year in prison, which was converted into two years of probation, while his right to practice medicine was revoked for a period of two years.

Petrit Rexhepi was sentenced to 6 months in prison, which was converted into 1 year of probation.

Doctor Burba appealed to the Supreme Court, but the latter, after reviewing the case in its entirety, decided not to accept it, because it found no violation.

According to the Supreme Court, the arguments given by the Court of Appeal are correct and the result of a careful analysis and in compliance with the law. According to the decision, the Court of Appeal found that the doctors performed negligent treatment on the patient Dorjana Haka, because they did not perform the necessary tests before she underwent surgical intervention to give birth to her first child.

"The deterioration of the health condition of the deceased patient Dorjana Haka could have been avoided if the medical personnel, including the two defendants in this process, had performed coagulation tests before performing the surgical intervention," the High Court emphasizes.

“The defendants, Anesthesiologist Elona Burba and Obstetric Surgeon Petrit Rexhepi, were before a planned operation, so they had all the time necessary to ensure that the patient Dorjana Haka was performed all the medical tests and examinations provided for by the medical protocol in force,” the decision states. The Supreme Court further argues that “the failure to perform the Coagulation Test on the deceased patient Dorjana Haka, before the surgical intervention constitutes unjustifiable medical negligence,” the court argues.

The decision further states that, contrary to what the defendants claim, the medical protocol for the patient was not implemented. "Also, the claim that we are facing objectively unavoidable complications according to medical science does not hold up, since the medical protocol provided for the performance of a coagulation test, in order to avoid such a possible complication," the website emphasizes.

Dorjana Haka gave birth to her first child, a boy, on November 4, 2014. Three days later, she suffered complications and was transferred from one hospital to another. Dorjana Haka passed away on the 16th day of hospitalization at the Mother Teresa University Hospital Center.
