The Albanian government has suffered a serious legal setback in its attempt to take control of Vlora International Airport following the Ministry of Infrastructure and Energy's announcement of the early termination of the concession contract.

By an emergency order dated September 16, 2026, the arbitrator appointed in the proceedings administered by the ICC has imposed a security measure ordering the Ministry not to take possession or operational control of the airport, not to demand the handover of assets, and not to replace the concessionaire company VIA with another operator.

The decision also prohibits any action that could change the existing situation or further escalate the dispute, until the establishment of the Arbitration Tribunal that will examine the case on the merits.

Although at this stage the validity of the termination of the contract has not been definitively decided, the implementation of its most important consequences has been blocked. In practice, the Government cannot take over the airport nor transfer the project to another operator.

The order constitutes a significant development in the conflict between VIA and the Ministry and raises serious questions about the haste with which the Albanian authorities attempted to create an irreversible situation before fully examining the dispute.

The Notice of Termination of the Contract would enter into force the next day, September 17, 2026, i.e. 30 working days after its announcement by the Ministry of Infrastructure on August 5. But the order of the Court of Arbitration in London prohibits the government from terminating the contract or taking any action to expropriate the concessionaire until its review of the case on the merits.

This puts Vlora airport in the face of a long delay scenario, if the government does not find a solution with the current concessionaire, as the arbitration case could take years to reach a final decision./ Kapitali.al
