Venice Commission Report: Suspension or replacement of mayors violates local
Venice Commission

The Venice Commission has issued a report on the practice of suspending and replacing mayors, warning that these actions constitute a serious violation of local autonomy and the will of the voters.

In the document adopted during the 144th plenary session on 24 October 2025, the European Commission for Democracy through Law states that:

“The suspension or termination of the mandate of mayors due to their arrest or detention affects the essence of local autonomy and violates the principles of the European Charter of Local Self-Government.”

The report emphasizes that the impact of these measures is twofold, as it harms not only the individual rights of the affected mayor, but also violates the democratic will of the voters, who may be left without real representation through political appointments.

“Replacing elected mayors with centrally appointed ones practically violates the will of the electorate, eroding the foundations of local democracy and violating the vertical separation of powers,” the report states.

The Commission also emphasizes that the detention and suspension of local representatives negatively affects the freedom of expression and peaceful assembly, transforming a preventive procedural measure into a restriction on democratic debate.

In another passage, the Commission underlines that any decision to suspend or dismiss must be an exceptional measure, clearly defined in law and justified only in serious cases, with full procedural guarantees and mandatory judicial review to avoid politicization.

" The suspension of a local elected official must pass the proportionality test and be taken by the judiciary, to avoid political influences, " the report emphasizes.

In conclusion, the Venice Commission warns that local democracy can only survive if elected representatives are free to exercise their mandate, while any intervention that replaces election with administrative appointment contradicts the spirit and letter of the European Charter of Local Self-Government.
