In his three-point reaction to the Constitutional Court's decision that left Erion Veliaj in office as Mayor of Tirana, Edi Rama says that the first two points have been met, while regarding the third, he suggests that time will prove it or not.
In the third point, the Prime Minister says verbatim:
"Any normal person who does not see in the Constitutional Court's position a blind stance against the government to the great detriment of Tirana, but rather a firm principled stance, cannot help but expect that with the same principle, when judging his detention, the Constitutional Court will return Erion Veliaj to duty, to continue the judicial process in a free state or not."
Simplified: Rama advises the mayor of Tirana, Erion Veliaj, to appeal the security measure of imprisonment to the Constitutional Court.
Legally, a direct request to the Constitutional Court for security measures would be rejected by this court for lack of jurisdiction, because the legislation provides for other courts for coercive measures.
But what Veliaj can file with the Constitutional Court is a request that this court examine whether the principle of proportionality has been violated in his case with the detention in prison, despite the fact that the investigations have been closed and SPAK has submitted the request for trial to the court.
