Socialist MP Erion Braçe , during his speech in the Assembly on the draft law " On Concessions and Public Private Partnership ", described the initiative as an important guarantee for improving the legal framework in this field, emphasizing that " no one can claim that the EU is demanding the non-approval of this law ."

Braçe focused on the point that prohibits the awarding of concession contracts worth 1 euro or the transfer of public assets of symbolic value, a practice he has criticized for years: " I am pleased that this space has been removed from the law. "

He emphasized that the draft law strengthens open competition and transparency in the awarding of contracts, but also raised some remarks on the broad scope of implementation of concessions and PPPs.

According to him, these instruments should not be used in sectors related to public order and security, citing as an example the return of passport and ID production under state control.

Braçe requested that open competition be extended to PPPs, recalling problematic experiences with the transfer of contracts, such as the case of Rinas airport or the large concentration of healthcare services "with only two owners, without significant benefits for the public ."

He stressed that transparency still remains lacking both before and after the award of concession contracts, and that there is a lack of strong control over their implementation. Braçe called for a clear obligation to identify beneficial owners, emphasizing that “they are often hidden behind offshore structures.”

We have continuously raised concerns here too, about concession contracts worth 1 euro or the transfer of public assets worth 1 euro. I am glad that this point is also not well-established in concessions. There will be no instrument for awarding concession contracts worth 1 euro. I have noticed, first of all, the wide scope for operating with these instruments. The law should have brought to attention that these two instruments are not operated in the fields of public order and security. We have taken a step forward in that the production of passports or IDs is in the state domain and not in private companies.

Secondly, open competition as a key element for defining concession contracts should also be extended to PPP contracts. We have had very bitter experiences regarding the transfer of contracts.

Rinas Airport was diverted to a Chinese consortium. The transfer of contracts has resulted in them not receiving the maximum possible benefits. Even in healthcare, we have a very large concentration in one or two owners but we have not received any benefits that leave you wondering. Two definitions, value for money, operational risk.

I think that transparency is not complete, either before or after the award of concession contracts. We have no significant control over the implementation of these contracts. Obligation for identifiable beneficial owners. They often appear hidden and come from offshore countries.
