The deputy of the floor Edmond Spaho with a status on Facebook has recycled the accusations made two years ago that the government and especially the Ministry of Energy and Industry had given the company that would build the incinerators a contract for the construction of the energy production plant from the combustion of waste for 25 years, guaranteeing the purchase of energy. 

For this, Spaho did not hesitate to accuse the former Minister of Energy and Industry Damian Gjiknuri by name. An accusation that greatly exalted Petrit Vasili of LSI, who apparently found the time to enjoy and distract himself from the hot CEZ-DIA case and its expected consequences for the heads of LSI. Vasili even declared that the discovery recycled two years later by Spaho was a bombshell.

First, Spaho and Vasili hint that the incinerator company had received a second concession that overlapped with the first one issued by the Ministry of Environment. Secondly, Spaho and Vasili hint that the company had received the right to produce and sell energy for 25 years, while the concession contract for the Elbasan incinerator was only for 7 years. So, as if he had the right to sell the energy even after he had delivered the work to the state.

The truth is actually quite different. First, the ministry led by Damian Gjiknuri has not signed any contract with any of the incinerators of Elbasan, Fier or Tirana. In the impossibility of involving him in this matter, after failing even with the history of allusions to hotel payments by the bosses of the incinerators, Spaho and Vasili have indirectly tried to exploit the element of energy production by using two speculations.

The Ministry of Energy and Industry has not issued a second concession to the incinerator company. Pursuant to the contract that the company had in force with the Ministry of Environment, approved by the government, it had acquired the right to build the plant together with the part of the technology that converts thermal energy from waste into electricity. Pursuant to this contract, the Ministry of Energy had the legal obligation to authorize and open the way for the licensing of the company "ALBTEK ENERGY" shpk. for energy production and trading. 

Njësoj si dhe autorizimet e tjera që jepen për gjenerim energjie edhe në burimet e gjenerimit nga uji, dielli apo era, kjo e drejtë lëshohet për 25  apo dhe me shume vite. Pra, kompania autorizohet të prodhojë dhe të shesë energjinë elektrike të prodhuar nga përpunimi i mbetjeve. Ky autorizim është detyrim kontraktual  por dhe sipas legjislacionit në fuqi. Jo lëshimi por moslëshimi i tij do të ishte një shkelje ligji nga ministria përgjegjëse.

Në përfundim të kontratës koncesionare, pra në përfundim të periudhës 7 vjeçare të koncesionit të inceneratorit të Elbasanit, kjo vepër transferohet në administrim të shtatë bashkive të Qarkut të Elbasanit. Kto të fundit marrin në pronësi veprën dhe fitojnë automatikisht edhe të drejtat e fituara nga kompania në raport me asetin. 

Pra, koncesionari transferon inceneratorin bashkë me kompaninë dhe autorizimin që ka “ALBTEK ENERGY” shpk për prodhimin dhe tregtimin e energjisë elektrike. Të ardhurat që gjenerohen nga prodhimi i energjisë elektrike pas marrjes në dorëzim të inceneratorit nga bashkitë e Qarkut të Elbasanit shkojnë tek ndërmarrja shtetërore dhe koncesionari nuk ka më lidhje me asgjë pas periudhës 7 vjeçare.

Sot që flasim 7 bashkitë e Qarkut të Elbasanit kanë inceneratorin bashkë me të gjitha të drejtat e tij përfshirë dhe prodhimin e energjisë. Këtë e di shumë mirë dhe SPAK madje e ka të evidentuar në dosjen hetimore. Siç mund të shihet në ekstraktin e QKB, shtatë bashkitë e Qarkut Elbasan kanë marrë impiantin bashkë me të drejtat e fituara për prodhim energjie. 

Në objektin e aktivitetit ECO-ELB është edhe prodhimi dhe shitja e energjisë elektrike, autorizimin për të cilën e ka të trashëguar nga "Albtek Energy" shpk. Ndërkohë, ECO ELB sikurse mund ta shikoni është e licencuar nga Enti Rregullator i Energjisë për veprimtarinë e prodhimit të energjisë elektrike nga centrali i përpunimit të mbetjeve urbane në Elbasan.

Pra e gjithë gurguleja se kompania e inceneratorit kishte marrë koncesion të dytë dhe të drejtën për të tregtuar energjinë për 25 vite, edhe pas përfundimit të afatit të koncesionit, rezulton të jetë një flluskë sapuni.

Ulërimat publike të Spahos dhe Vasilit ndaj SPAK-ut kanë vetëm një përgjigje: nuk ka asnjë shkelje ligjore ndaj nuk mund të ketë asnjë përgjegjës.
