Opposition leader Sali Berisha participated today in a roundtable organized by the Albanian Police Center and the “KONRAD ADENAUER” Foundation on the topic: “Assessment of the Justice Reform in Albania. Challenges, Consequences and the Right Path.”
During his speech to the audience, Berisha said that the Justice Reform in Albania is the ugliest experiment of the extreme left in Europe.
He also added that this reform was secretly designed in a secret document of the Open Society Foundation, run by billionaire George Soros.
The former Prime Minister also said that Albanians, ever since the 1990s until this process was implemented, have not had a perfect legal process, but they have had an acceptable legal process.
"I want to thank Edith and Diana, who courageously took on the task of addressing this extremely important issue with the Adenauer Foundation, which carries with it some truly incredible truths for a NATO member country that aspires to integrate into the EU.
The justice reform in Albania, let's be frank, was secretly designed in a secret document of the Open Society Foundation.
A document, which was made public in one of these well-known publications, in which we saw that this foundation had drafted a strategy in which it defined profound changes, reform of the Constitution, reform of the justice system, and electoral reform.
I will not stop here now on the 10-year history, but it is normal and we have asked for the help of our friends, the Adenauer Foundation, to study this reality, so that it is not accepted as a taboo, because taboos are typical phenomena for dictatorships and autocracies. For a free and democratic system, reforms are its constant.
But, if we take a 10-year balance sheet of this reform carried out by the extreme left, what is it?
The first is the denial of the right of Albanians, not by law, but by facts and reality, to have a fair legal process.
"Albanians, ever since the '90s until this process was implemented, have not had a perfect legal process, but they have had an acceptable legal process ," Berisha said.
Berisha says that the creation of a stock of files is costing the country billions of Euros in losses.
"And, those who sleep on the files, those who sleep on the right of citizens to have a fair legal process, they are no longer awake. They issue statements in defense of this major failure with catastrophic consequences for Albania, because the blocking or annihilation of civil cases, de facto costs the country billions of Euros in losses. On the other hand, this blocking has eliminated legal certainty in this country. So important and so vital for the rule of law. Legal certainty no longer exists here. This situation has completely blocked foreign investments in this country. It has deprived the country of billions.
"What you have read, they are all about TAP, Devoll and Fani. The others are purchases of apartments by Albanian emigrants, who are registered here as foreigners. Because there is no foreigner who can come to invest in a country when he sees that a civil case has to wait 15 years. So, this is an extremely serious consequence for the Albanian citizen. But, now we take some other aspects of this reform. Another dramatic, anti-democratic, unconstitutional aspect of it is the police control of the prosecutor over the judge who hands over the file. This was not even in the dictatorship ," Berisha said.
Among other things, during his speech, Berisha said that the presumption of innocence has also disappeared in this system. The leader of the Democrats emphasized that justice has now become a powerful political weapon in the hands of the regime against the opposition.
"Third, just as important. The presumption of innocence, the fundamental principle of the presumption of innocence, has disappeared in this system. If you look at the prison population, 62 percent of the prisoners in this country are detained, people under investigation, people who absolutely most of them should not be where they are. But this is a strict police system, the police arrest you and leave you there, no one talks to you anymore. And there, 62 percent of the prisoners are detained. Not even the harshest dictatorships have this percentage. But this exists because there are no prosecutors and judges here. To clarify the decision, it takes 4 or 5 months or you have to bring in a friend to clarify the decision. Now, these are the serious consequences for the Albanian citizen. We have another documented, factual problem. This justice has its undeniable political wing.
There is no more serious act than the amnesty of electoral crime. Because it actually constitutes a license to block the rotation of power. It constitutes a license to use crime and manipulate the will of the voters. Secondly, as I said above, a justice system that in the electoral year, arrests as persons under investigation the leaders of the three main opposition parties. Identical behavior to Zajedi of Tunisia. But Zajedi, unlike Zajedi of Tirana, did not publicly rape any of them in the middle of the street as Lukashenko of Tirana did with Ilir Meta. Or as they did by taking mandates from Fredi Beleri and Ervin Salianji. So, it has become a powerful political weapon in the hands of the regime", Berisha emphasized.
