Kosovo's Constitutional Court overturns PDK: Government vote regular!

The Constitutional Court of Kosovo has declared that the Assembly of Kosovo was constituted beyond the 30-day deadline, but MPs must still elect the second vice-president from the ranks of the Democratic Party of Kosovo.

In a press release, the Constitutional Court says that the new Government of Kosovo has been elected in accordance with the Constitution. The court also said that the 60-day deadline for electing the president began on August 8 and ends on October 6.

The Constitutional Court's announcement comes after the Democratic Party of Kosovo, through two requests, contested the constitution of the Assembly and the election of the executive. The Constitutional Court also rejected the PDK's request for the imposition of a temporary measure on the proceedings of the Assembly.

On September 13, without the presence of the deputies of the Democratic Party of Kosovo and the Alliance, the deputies of the Vetëvendosje Movement, the Democratic League of Kosovo, and those of the non-majority communities voted for the constitution of the Assembly.

The Constitutional Court of the Republic of Kosovo, on 23 September 2026, ruled on the joint requests KO256/26 and KO258/26, regarding the assessment of the constitutionality of “Decision No. 11-V-002, of 9 September 2026, on the election of the Speaker of the Assembly; Procedural Decision of 11 September 2026 on the manner of voting for the Deputy Speakers; and the finding of 13 September 2026 on the constitution of the XI legislature of the Assembly”, as well as “Decision No. 11-V-007, of 13 September 2026, on the election of the Government of the Republic of Kosovo”, submitted by: KO256/26, Arian Tahiri and nine (9) other deputies of the Assembly of the Republic of Kosovo; and KO258/26, Arian Tahiri and ten (10) other deputies of the Assembly of the Republic of Kosovo, based on paragraph 5 of Article 113 [Jurisdiction and Authorized Parties] of the Constitution of the Republic of Kosovo.

The court, unanimously, ruled:

I. TO DECLARE the request admissible;

II. TO STATE that the Assembly of the Republic of Kosovo was constituted after the expiry of the thirty (30) day period, set out in paragraph 1 of Article 66 [Election and Mandate] of the Constitution of the Republic of Kosovo;

III. TO STATE that the expiry of the thirty (30) day period for the constitution of the Assembly of the Republic of Kosovo, as set out in paragraph 1 of Article 66 [Election and Mandate] of the Constitution of the Republic of Kosovo, shall result in the commencement of the constitutional deadlines for the election of the President of the Republic of Kosovo, when the position of President is vacant, and for the election of the Government of the Republic of Kosovo pursuant to Articles 86 [Election of the President], 95 [Election of the Government] and subparagraphs 1 and 3, paragraph 1 of Article 82 [Dissolution of the Assembly] of the Constitution of the Republic of Kosovo;

IV. TO STATE that the members of the Assembly of the Republic of Kosovo shall, as soon as possible, elect the Deputy Speaker of the Assembly of the Republic of Kosovo from among the second largest parliamentary group, in accordance with paragraph 3 of Article 67 [Election of the Speaker and Deputy Speakers] of the Constitution of the Republic of Kosovo;

V. TO STATE that the Decision [No. 11-V-007] of 13 September 2026 of the Assembly of the Republic of Kosovo on the election of the Government of the Republic of Kosovo is not in conflict with Article 95 [Election of the Government] of the Constitution of the Republic of Kosovo;

VI. TO STATE that the sixty (60) day period for the election of the President of the Republic of Kosovo, pursuant to subparagraph 3, paragraph 1 of Article 82 [Dissolution of the Assembly] of the Constitution of the Republic of Kosovo, began on 8 August 2026 and ends on 6 October 2026;

VII. TO REJECT the request for interim measures;

VIII. TO NOTIFY this Judgment to the parties;

IX. TO PUBLISH this Judgment in the Official Gazette of the Republic of Kosovo, in accordance with paragraph 4 of Article 20 (Decisions) of Law No. 03/L-121 on the Constitutional Court of the Republic of Kosovo;

X. TO STATE that this Judgment enters into force on the day of its publication by the Constitutional Court of the Republic of Kosovo.
