What the law says: Can Donald Trump withdraw the US from NATO?

US President Donald Trump's recent statements about the possibility of the US withdrawing from NATO have revived the debate over his powers and legal limitations.

Since the start of the war with Iran, Trump has repeatedly criticized the military alliance, warning that he may consider leaving the US from the organization created in 1949 to guarantee security in Europe and North America.

However, a law passed by the US Congress in 2023 stipulates that the president cannot withdraw the US from NATO without the approval of the Senate, which requires the support of two-thirds of senators, or without a separate act of Congress.

Republican Senator Thom Tillis has stated that such a withdrawal is not possible without the involvement of Congress, emphasizing that the president can influence the functioning of the alliance, but not abandon it unilaterally.

On the other hand, a 2020 legal opinion from the Department of Justice suggests that the president has broad authority over international treaties, which leaves room for different interpretations.

According to experts and Congressional Research Service analysis, a unilateral decision to leave NATO could end up in court, making the issue not only political, but also legal.
