The Energy Regulatory Body has started the procedures for the removal of the licenses of entities that have not liquidated the regulatory payments to this institution. According to the legislation in force, this is the most severe measure in case of violation of this obligation, while the decisions affecting at least 21 licenses came after there was no reaction from them, even after notifications about the violation of this obligation.
Before reaching the penalties with a fine, the legislation in force determines the penalty with a fine of up to 3 percent of the income of the previous year of the licensee. Likewise, the law entitles ERE to apply a late interest on the value of the regulatory payment, at the rate of 0.2% of the daily turnover for each day of delay in its payment.
But, although the Entity has proceeded with the imposition of fines, the subjects have not reacted, leading to the removal of the license as a more serious measure in case of non-liquidation of regulatory payments. However, this is not the final step for the revocation, as the experience of the past years has shown that after the initiation of the procedures by the ERE, the subjects have started the liquidation of the obligations, which has brought "forgiveness" from the Entity. For 2023, an increase in income for ERE was predicted, due to the increase in the profit of companies operating in the electricity market during 2022.
This institution aims to collect about 326.4 million ALL from regulatory payments for 2023 from licensed entities in the electricity and natural gas sector. Meanwhile, compared to a year ago, there are over 118 million ALL of additional income, since last year this value reached 208 million ALL.
