The Constitutional Court has considered the request of the Association of Builders of Albania, which requests the partial annulment of the decision approved a year ago, which determined the new reference prices for the sale and purchase of housing units in Tirana.

Builders have argued that the decision has a retroactive effect and taxes with the new value even those permits granted before its entry into force, undermining their profit. It is also argued that the rising costs of construction have not been taken into account.

"By violating the expected profit, the property right has been violated. They have changed the prices only for Tirana, in a drastic and unstudied way. When the municipality issues the permit, 8% is required to be paid by the builder. What will we pay? 8% under the previous benchmark, or 8% after the new reference prices come into force? When permits are obtained, builders start selling with order contracts which eventually become final. I can't tell the buyer you will pay more because they raised my taxes? It demotivates entrepreneurs and can cause less income in the budget".

But representatives of the government reject these arguments, which according to them have no legal basis.

The Constitutional Court has asked the Association of Builders to present concrete figures on how many permits were affected by the decision on the change in reference prices and their deadlines. The submission of evidence on how this decision has affected the decline in apartment sales has also been requested.
