Four days after the prison sentence, Ervin Salianji addressed the Supreme Court with a letter requesting the suspension of the decision of the Court of Appeal , which sentenced him to 1 year of imprisonment.

In the letter, it is argued, among other things, that the suspension of the execution is important in addition to serving the prison sentence, but also for preserving the mandate of the deputy as a mandate that belongs to the people.

" Regarding the current quality of the deputy, we will refer to the fact that there is still no decision-making by the State Election Commissioner in application of Article 164 of K. Zgjedhor1, which means that the suspension of execution is important except for the serving of the sentence with imprisonment, but also for preserving the mandate of the deputy as a mandate that belongs to the people.

Given that the petitioner Ervin Salianji was elected deputy by the people with over 10 thousand preferential votes in the 2021 elections, these elections took place after the decision of the Court of the Judicial District of Tirana (18.12.2019), this decision is left in force by the decision of Court of Appeal of General Jurisdiction, is indicative of the special cause presented by this case in the sense of article 476 point 1 of the Penal Code.

The vote of confidence given by the people, regardless of a court decision given earlier, is an indication of the uniqueness of the case under review, moreover, that sovereignty in the Republic of Albania belongs to the people ", the letter addressed to the Supreme Court states .
