Sick prisoners die because of aggressive court decisions

Today, a convict lost his life near IEVP Durrës, hanging himself. The deceased's name was Roland Hasani and he was about 40 years old. An ambulance took him to the hospital in serious condition, but due to the bureaucratic procedures that caused the delay, it was impossible for Hasan to be saved.

The death of the 40-year-old is one of the many cases where sick prisoners are allowed to be sent to prisons without providing first aid.

Andon Mëhillaj is another prisoner who lost his life from a heart attack, in Peqin prison, on February 2, 2020. For some time he had expressed concerns about his health, but neither the court changed the security measures nor the medical assistance was given on time.

Earlier it was the convict Erjon Bushi, 38 years old, who died in Fushë-Kruja prison on April 6, 2018. Bushi died of a heart attack, just like his co-sufferer Andon Mehillaj.

Blerim Xheja from Elbasan, 52 years old, had requested the change of the security measure, due to his health condition. But he died in Beijing prison on February 9, 2017, from cardiac arrest. Neither the court reacted nor the ambulance rushed to save him.

A few months ago, on February 9, 2022, Artur Gjoci, 46, died of a heart attack in Peqin prison. There are dozens of such cases, where prisoners have lost their lives from various diseases, because the country's courts have shown stubbornness with security measures.

The criminal code provides that for special reasons of the health condition of the prisoner or detainee, it is allowed to replace the measure of arrest, from prison arrest to house arrest, so that it becomes possible to improve the treatment conditions. What is most important is to be able to be sent by emergency to the hospitals in case of need, since if the prisoner is in the premises of the IEVP, it takes a lot of time and the written procedure to make it possible to send him to the emergency.

The main culprits for these deaths are the decisions of judges, who in most cases, under the guise of judicial reform, refuse to replace arrest measures for prisoners, arguing that medical treatment can be done in isolated environments.

But from the cases shown above, and others, it is obvious that the sick in prisons do not manage to escape.

Basic human rights provide for deprivation of liberty in cases of investigation or punishment, but not endangering the person's life and creating conditions for medical treatment and cure. This right is being censured by our courts, causing the death of dozens of detainees.

This should be a strong alarm signal for the prosecutor's office and the courts, that the principle of humanity and the priority of human life before the isolation of suspects for criminal offenses at all costs, should be paramount.

Isolation of patients with life-threatening diseases must be stopped and there should be no tragic loss of life in conditions of detention, where the prison staff from guaranteeing the life of the detainees becomes their escort to the apartment The last.
