Ervin Salianji entering the court

The Court of Appeal of Tirana decided to uphold the decision of the First Instance for Ervin Salianji and his sentence of 1 year in prison for the "Babalja" case.

The Democratic deputy was convicted by the First Degree of making a false report regarding wiretapping in May 2018.

What happened today?

Ervin Salianji arrived at the Court of Appeal of the General Jurisdiction a few minutes before the official schedule of the court session, during which he would be informed of the final verdict on his fate. He was accompanied by a large number of opposition MPs.

At the end of a process that dragged on for years, he was sentenced to one year in prison for the "Babale" file.

Salianji is expected to go behind bars, as soon as the order to execute the decision is issued.

After waiting a few minutes outside, Salianji entered the courtroom, where he also exchanged jokes with the journalists. "You're dressed like you're in prison," one of the journalists told him. "I am prepared", Salianji replied.

What happened in the session?

At the beginning of the session there were debates. The reason was a decision of the Court of Serious Crimes of that time, which stopped drug trafficking investigations for Geron Xhafaj, the brother of the former Minister of the Interior, Fatmir Xhafaj.

Salianji's defense argued that the decision could not be administered as evidence at this stage of the process since the decision was brought by mail by Xhafaj's lawyer.

This even brought the reaction of Salianj himself.

"To come to a decision at this stage is illegal", said Salianji.

This has brought the reaction of the judging panel itself, who have called on Salianji to be careful with ethics.

"Truth is more careful than ethics", answered the deputy again.

Meanwhile, Geron Xhafaj's lawyer emphasized that the decision was made in accordance with the law.

After retiring for 10 minutes in the deliberation room, the court pronounced the verdict, leaving in force the decision of the court of first instance. Therefore, he sentenced Ervin Salianj to one year in prison.

After the decision, journalists present at the session reported that Salianji's "hands were shaking, he was drinking water and trying to keep his composure".

Ervin Salianji then appeared in front of the media and described the punishment as a political attack and revenge by Fatmir Xhafa.

Gazmend Bardhi accused the court of punishing the opposition MPs unfairly. "Your mind is lying that by condemning the opposition you will go to the Supreme Court", said Bardhi, addressing the jury.

What happens now with Salianj?

After the decision, Ervin Salianji will have to go to jail as the decision of the Court of Appeal is enforceable.

The decision will be sent to the relevant police station to receive and send Salianj to the Local Police Directorate of Tirana.

From there, the General Directorate of Prisons will decide where Salianji will serve his sentence.

Ervin Salianji is a deputy and has immunity, but what does the law provide?

Article 71, point 2, letter dh, states that the mandate of the deputy ends or is invalid when he is convicted by a final court decision for committing a crime.

However, regardless of this, in order to remove Salianji's immunity, confirmation from the Council of Mandates is required.

For this reason, the decision and the order for the execution of the sentence must be sent to the Assembly.

"Babalja" trial

In connection with this case, judge Artan Gjermeni of the Court of First Instance sentenced Salianj to 1 year in prison on December 18, 2019. Fredi Alizoti, who was named as a false witness in the audio recording, was also sentenced to 2 years in prison for a false report.

Albert Veliu, known by the nickname "Babalja", was sentenced to 3 years and 5 months in prison, for the criminal offenses of illegal border crossing and false reporting.

As for the journalist Jetmir Olldashi, the Court decided to convert the 6-month prison sentence to 100 hours of work.
