Veliaj's lawsuit against Ols Dado, hearing in the Administrative Court today

The Administrative Court is reviewing today the lawsuit filed by Erion Veliaj against SPAK prosecutor Ols Dado, who according to him was appointed as a prosecutor in violation of the law in 2008. According to Veliaj, Dado did not complete the Magistrates' School, failing to meet the requirements to qualify as a prosecutor.

According to Veliaj's claim, Dado has not completed the Magistrate's School and does not even meet the exclusion criteria for qualification.

Plarent Ndreca stated that the KLP has also become part of this 'institutional harmony' to prevent substantive review.

According to him, from the development of the judicial process itself and the evidence administered so far, it results that the President of the Republic, at the time of decreeing Ols Dado as prosecutor, did not conduct real verifications on the fulfillment of the legal conditions for his appointment.

"Instead of seeking a substantive examination of the case and the clarification of the legal truth on the validity of the presidential decree, the representative of the KLP has appeared in court with the same procedural strategy as the subject itself that is the object of control, by attacking the legitimacy of the plaintiffs. The KLP is trying to prevent its own substantive examination. So the constitutional body that should guarantee the legality and integrity of the prosecutorial system becomes part of an institutional protective mechanism that aims to procedurally close a problem with very serious consequences for the rule of law," said Ndreca. 

The debates unfolding in the Administrative Court prove that the president of the time, Bamir Topi, who signed the decree on Dado, only had a proposal from the Prosecutor General and the accompanying letter.

The lawyer once again guaranteed that he will demand full transparency in court and live broadcast of the hearings, as according to the arguments, Erion Veliaj is not in the service of the capital, even though he is mayor, due to a decision made by an authority that does not exist and this has harmed the interests of hundreds of thousands of citizens of Tirana.

Dado's lawyer has asked the court to dismiss the lawsuit, emphasizing that the criminal process where Erjon Veliaj is the defendant is not affected, as the case also has a second prosecutor, Altin Duman.

Mayor Veliaj has also asked internationals to attend the May 8th session where his lawsuit for the illegal appointment of special prosecutor Ols Dado is being reviewed and to ask the black squads for live broadcast of the process.
