The President of the Criminal Lawyers Association of Albania, Joana Qeleshi , has reacted harshly regarding the arrest of lawyer Ulian Barjami , who was detained immediately after the end of a court session, while performing his duties.

The incident, which occurred after a debate between him and prosecutor Gjergji Ceka , has been described as an unprecedented and unacceptable act by the Association.

Through this public reaction, Qeleshi emphasizes that the arrest is a direct blow to the role of the lawyer in the justice system and seriously violates the right to independent and impartial defense.

The Criminal Lawyers Association of Albania expresses its deep indignation and strongly condemns the unprecedented act of arresting lawyer Ulian Bajrami while exercising his duty at the end of a court session, following a debate during the trial with the representative of the prosecution.

According to information made public and the audio of the court session, lawyer Ulian Bajrami was arrested solely for the fact that he communicated to the prosecutor his intention to file a criminal report, as according to the lawyer, the latter had manipulated evidence to the detriment of the client he was defending.

This action constitutes a direct attack on the independence of the legal profession, seriously violating the constitutional principle of the right to independent and effective defense, guaranteed by Article 31 of the Constitution and Article 6 of the European Convention on Human Rights.

The lawyer, as an essential part of the justice system, cannot and should not be punished for exercising his legal function in protecting the interests of the citizen and confronting abuses of power.

The arrest of a lawyer for exercising his or her duties is an unacceptable act that seriously undermines public confidence in justice and violates the balance of due process.

The Albanian Criminal Lawyers Association requests:

 1. The immediate and unconditional release of the arrested lawyer;

 2. A full, independent and transparent investigation into the actions of the responsible authorities;

 3. Taking disciplinary and legal measures against any official who has abused his public office to intimidate the defense representative;

 4. Institutional guarantee that such events will not be repeated.

"This act is a serious violation of the fundamental principles of the rule of law."

The arrest of a lawyer for demanding law enforcement is a frightening message to the entire legal profession and to citizens seeking justice.

The Criminal Lawyers Association of Albania will not remain silent and allow the independence of the defense to become an object of pressure or punishment.
