Courts are 'flooded' with files, 150 thousand cases pending!

In all courts of the country, the year 2025 ended with about 150 thousand files waiting to be reviewed at all three levels of trial.

The figures that the High Judicial Council presented in the report submitted to parliament show the aggravated situation, where chaos appears in the General Court of Appeal but also in the Administrative Appeal.

To review a civil claim, for a property right or even a pension, Albanians have to wait almost 12 years until a decision is made by all three levels of the judiciary.

When in the spring of 2024 the High Judicial Council (HJC) presented the 3-year national strategy for reducing backlogs in courts, there were about 114 thousand files at all levels.

Today, two years later, figures provided by the Supreme Court itself show that not only has there been no sign of improvement, but the situation has worsened significantly. And the system is flooded with nearly 36,000 more files, or an increase of 33 percent.

All this translates into more waiting time and suffering to receive justice. Especially for those facing civil cases which represent almost 70% of the backlog of files. An Albanian citizen to resolve a civil conflict today in the country's courts would need on average just under 12 years across all three levels of the judiciary: 270 days in the First Instance, 2318 days (over 6 years) in the Court of Appeal, and 1762 days (or more than 4 and a half years) in the High Court.

COURT OF APPEAL OF GENERAL JURISDICTION

The KLGJ report states that in the basements and offices of the Court of Appeal of general jurisdiction, 56,990 files are waiting for review, an increase of over 15 thousand compared to the beginning of 2024 when there were 41,700, or almost double what they were in February 2023 when the implementation of the new judicial map began, which merged the 6 Courts of Appeal scattered throughout the country into a single one.

The backlog has reached its highest level in recent years with 45,876 cases waiting for years, 42% of them for over 3 years, while 14% (i.e. 1 in 7 files) have been waiting for more than 5 years.

Civil cases constitute the "Achilles' heel", with 67% of backlogged files. Criminal files, also due to the time limits they have, are reviewed significantly faster in the Appeals, on average in 920 days, almost 2 and a half years, much less, compared to the 6 years of a civil case.

Currently, the Court of Appeals is missing 42 judges out of a total of 78, as there are currently 36 in the organic structure, while even fewer are actually working. In 2025, each judge of the Appeals had an extraordinary overload of 1804 files each.

Edhe Gjykata e Lartë vijon të përballet me një stok jashtëzakonisht të madh dosjesh edhe pse KLGJ-ja i sheh me optimizëm shifrat e vitit 2025.

Reduktimi prej 20% i backlog-ut përbën një indikator të qartë se Gjykata e Lartë ka hyrë në fazë aktive të reduktimit të stokut, ndryshe nga nivelet e tjera të sistemit që ndodhen ende në fazë stabilizimi. Gjykata e Lartë për vitin 2025 shënon një kthesë të rëndësishme drejt reduktimit të backlogut, duke kaluar nga një fazë akumulimi historik në një fazë aktive të përmirësimit të efiçencës dhe administrimit gjyqësor.

Në fillim të vitit 2025 kjo gjykatë numëronte 20.888 dosje, ndërsa në fund të 2025 kishte 16,445 çështje në pritje të gjykimit. Pavarësisht kësaj 16 gjyqtarët e Gjykatës së Lartë vijojnë të përballojnë një volum shumë të madh pune, ku secili prej tyre ka 1, 405 dosje në dorë për t’i shqyrtuar.

Përveç çështjeve civile për të cilat duhen mesatarisht, 1762 ditë për të dhënë një vendim përfundimtar, ato administrative duan 641 ditë, ndërsa penalet 89 ditë.

Edhe në këtë Gjykatë  backlog-u, sipas natyrës së çështjeve, evidenton një dominim të qartë të juridiksionit civil me 64% por një peshë të konsiderueshme kanë edhe çështjet administrative që përbëjnë 28% të dosjeve stok. Vetëm 8% janë penale.

GJYKATAT ADMINISTRATIVE

Pas Apelit të juridiksionit të përgjithshëm janë pikërisht Gjykatat Administrative që vijojnë në ngërç shumë të madh. Trendi rritës i dosjeve të mbetura stok ka vijuar edhe vitin e kaluar. Në fund të vitit 2025 kishte 24,530 çështje pa një vendim, por sipas KLGJ-ës, ritmi i rritjes së backlog-ut në vitin 2025 rezulton 57% më i ulët krahasuar me vitin 2024, dhe 71% më i ulët krahasuar me vitin 2023.

Në Administrativen e Apelit janë vetëm 11 gjyqtarë gjithsej nga 22 që është organika dhe vitin e kaluar ngarkesa mesatare e punës për gjyqtar ka arritur në 2,116 çështje për secilin. Më e ngarkuara se në çdo gjykatë.

Edhe pse ka një përmirësim të rendimentit thotë KLGJ ende situata duket larg zgjidhjes edhe për shkak të një backlog-u me strukturë shumë të rëndë historike. 59% e çështjeve janë mbi 3 vite në pritje dhe 30.5% janë mbi 5 vite.

As në dy gjykatat administrative të shkallës së parë, gjendja nuk paraqitet optimiste. Ato e mbyllën 2025-n me 21,621 çështje nga të cilat 8,396 të prapambetura.

Gati 79% e stokut total mbahet nga Gjykata Administrative e Shkallës së Parë Tiranë dhe vetëm 21% nga ajo në Lushnje. Përqendrimi në Tiranë shikohet si një shqetësim nga KLGJ.

Ngarkesa mesatare e punës për gjyqtar, në gjykatat administrative të shkallës së parë ka arritur në 818 çështje për gjyqtar, duke shënuar një rënie prej 24% krahasuar me vitin 2024. Kjo për shkak të rritjes së numrit të togave të zeza në këto gjykata.

FIRST INSTANCE COURTS

The first instance courts also appear to be struggling. At the end of 2025, the first instance courts of general jurisdiction reported a total of 39,767 cases pending review. Tirana has the 'lion's share' with 42% of the national total at this judicial level, followed by Fier and Durrës. Due to the decrease in the number of cases compared to previous years but also the increase in the number of judges, in the 13 first instance courts in the country in 2025, the average workload per judge is 607 cases per judge, compared to 750 cases per judge in 2024.

SPECIAL COURTS

The special courts against Corruption and Organized Crime seem calmer, where the Appeals Court in 2025 had only 461 files, while 98% of cases were completed within 6 months, indicating, according to the Supreme Court of Justice, a fast pace for most cases. 35 cases were reviewed in 6-12 months, 23 cases from 1-2 years and 9 cases have spent over 2 years pending. While the first instance GJKKO for 2025 had 3,245 cases, including those carried over from 2024 and newly registered ones.

UNFILLED VACANCIES

According to the report, there were a total of 306 judges in the courts of all three levels across the country in 2025. This means that the judicial system during 2025 functioned at almost 73.38% of its capacity.

Meanwhile, 21 judges have been dismissed during the vetting process in just one year. This means that the number of vacancies in the system for magistrates (judges) is 111, of which 73 are permanent and 38 are temporary.

Albania has an average of 17.3 judges per 100 thousand inhabitants, which, according to the Supreme Court of Justice, is far from the European average of 21.9 judges per 100 thousand inhabitants./ Albanian
