The Berat Court declares lack of jurisdiction over the case of the former director of AMP, the case is transferred to Tirana!

The former Director General of the Police Supervision Agency (AMP), Florian Sulejmani , appeared today at the First Instance Court of General Jurisdiction in Berat, for the verification of the personal security measure "suspension from duty".

The court declared territorial incompetence and transferred the case to Tirana.

The Berat Court had accepted the request of the Berat Prosecution Office for the suspension from duty of the director of the Police Supervision Agency, Florian Sulejmani, as he is under investigation for abuse of office in connection with the procedure followed in the transfer of judicial police officers, which is suspected to have been carried out in violation of the relevant legislation.

Berat court decision:

Based on articles 228, 229, 242, 248 of the Code of Criminal Procedure and article 248 of the Criminal Code,

DECIDED:

Continuation of the preventive personal security measure of "Suspension of the exercise of a public duty or service", provided for by article 242 of the Criminal Procedure Code for the person under investigation Florian Sulejmani, born on 20.12.1977, born in Dibër and residing in Tirana, with the position of General Director of the Police Supervision Agency, suspected of committing the criminal offense of "Abuse of office", provided for by article 248 of the Criminal Code.

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Berat and the Berat Judicial Police are charged with implementing this decision.

Court costs as incurred.

An appeal may be filed against this decision (which, according to Article 248 of the CPC, shall be filed with justification within 48 hours) at the Court of Appeal of General Jurisdiction, within 5 (five) days, this deadline starting from the day after the notification of this decision.

Sending the acts to the Court of First Instance of General Jurisdiction of Tirana as the competent territorial court for the trial of this case.
