The Special Court of Appeal has rejected the request of Tirana Mayor Erion Veliaj , who opposes the first instance decision to suspend pre-trial detention.

The previous hearing was postponed due to procedural problems related to the notification of the defendant by the Durrës Prison Directorate.

According to Judge Saida Dollani, the institution had only presented a copy of the document proving Veliaj's knowledge of the trial, and not the original version, which was considered an irregularity.

The decision to suspend the deadlines was previously taken by the Special Court against Corruption and Organized Crime, in two separate sessions, due to the absence of several other defendants in the process.

Veliaj objects to this practice, arguing that he has been consistently represented by his lawyer and that the detention terms should not be suspended collectively for all defendants, due to delays related to other persons.

The case has sparked broader debate in the justice system, as the practice of suspending deadlines for all defendants is being considered problematic by lawyers.

Lawyers are calling for a review of the provisions in the Criminal Procedure Code, emphasizing that this approach could violate individual rights and detain persons who are not responsible for the delays in the process.

Under current legislation, time spent in detention is counted with a higher coefficient in the final sentence, making this issue even more sensitive for defendants.

The Mayor of Tirana has been under "prison arrest" since February 10, 2025. He faces several charges, including passive corruption in several cases, money laundering, failure to declare assets, and abuse of office.
