A company submits false documents in the 50 million euro national road maintenance tender to meet mandatory criteria.
The Road Authority announces the winning company, Kapital media published the forged documents.
What happens next?
Caught unawares, the Albanian Road Authority plunges even deeper into crime by replacing the forged documents after the tender had been held and the company had been declared the winner. Thus, changing the documents after the competition.
This in the photo below is the document that proves the serious forgery for the second lot of the maintenance tender, which had a limit fund of 1.1 billion lek or 12 million euros.

In this document, the winning company Bami admits that in the declaration form it had declared that it had a deregistered snowplow. But after the scandal became public, the company says that it has replaced it with another vehicle. All this is accepted by the ARA, even though the tender was held.
Manipulation and winner-fixing
The tender for the maintenance of national roads in the next 4 years was in two phases.
In the first phase, otherwise called short listing, companies had to submit documents to prove that they had the necessary capacities to perform the service.
One of these criteria was the possession of 11 snowplows, which would guarantee road maintenance. If a company did not possess these snowplows, then it was automatically disqualified from the tender.

These are the snowplows declared by the Bami company. As can be seen in the photo, one of them is the snowplow with license plate AA981J. Based on these documents, the Albanian Road Authority disqualified all the participating companies in the first phase, qualifying only Bami. But Kapitali denounced the scandal and published the forged documents.
This was the document that proved that the snowplow with license plate AA 981 J, presented on the form by the Bami company, was deregistered.
After the scandal was published, and after one of the other competing companies, Alko Impex, reported the forgery of the documents to the KPP, the Bami company submitted another statement replacing the deregistered vehicle.
This is because the tender had been held and it had been declared the winner in the first phase, being the only company to advance to the second phase that had the right to make a financial offer.
The Albanian Road Authority has admitted to replacing the forged documents after the competition. This is a serious forgery, which constitutes a criminal offense. In practice, the ARRSH manipulated the tender by predetermining the winner to a company that did not meet the criteria, and worse still by changing the documents after the competition, to hide the crime.
The issue of the maintenance tender is already in SPAK. This document makes the prosecutors' job much easier to prove the falsification and manipulation of the tender by the ARA, since the crime has already been proven.
The members of the Bid Evaluation Committee, who declared the winner the company with forged documents, have repeated the crime even more seriously when they admitted to replacing the forged documents after the competition.
This also burdens them with the fact that they were aware of what they were doing, removing the opportunity to hide behind the excuse that they did not know that the letters were forged.
In short, this is an even more serious scandal than the Unaza scandal, where a company with forged documents was also declared the winner. But in that case, after the scandal became public, the ARA canceled the tender.
In this case, the opposite happened. Even though it was aware of the forged documents, the ARA continued with the procedure, accepting the company's financial offer in the second phase, and declaring it the winner.

In fact, the chain of responsibilities should be expanded further to include the Public Procurement Commission, which, although informed that the winning company had been declared so with forged documents, not only did it not disqualify it, but allowed the tender to continue./ Kapital
